Bradberry, <br />non -collusion affidavit was in <br />order, and a 5% bid bond was <br />submitted. <br />Bid was signed by Ronald N. <br />Howell, non -collusion affidavit <br />was in order, and a 5% bid bond <br />was submitted. <br />Bid was signed by Frederick E. <br />Woodruff, non -collusion affidavit <br />was in order, and a 5% bid bond <br />was submitted. <br />Bid was signed by Henry DeWulf, <br />non -collusion affidavit was in <br />order, and a 5`/o bid bond was <br />submitted. <br />Bid was signed by Richard LaFree, <br />non -collusion affidavit was in <br />order, and a 5% bid bond was <br />submitted. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and <br />carried, the above bids were referred to the Engineering Department <br />for review and recommendation. <br />VACATION RESOLUTION NO. 3515, 1981 - CONFIRTIED (WELLINGTON STREET) <br />This was the date set for holding a public hearing on Vacation Resolu- <br />tion No. 3515, 1981, for the vacation of Wellington Street from <br />the southerly right-of-way line of Ardmore Trail to the northerly <br />right-of-way line of Prast Boulevard for a distance of approximately <br />400 feet; all being in Westchester Second Addition to the City of <br />South Bend. The clerk tendered proofs of publication of notice in <br />the South Bend Tribune and the Tri-County News which were found to <br />be sufficient. It was noted that a notice had been sent to all <br />property owners in the vicinity of the proposed vacation and letters <br />had been received from the various city agencies indicating that <br />there was no objection to the proposed vacation. There was no one <br />present to remonstrate against the vacation and no written remonstrances <br />had been received. Mr. John Peddycord, attorney representing LaSalle <br />Square Associates, petitioner in the vacation proceedings, stated that <br />the Area Plan Commission had approved the vacation of the street <br />subject to the required utility easement because of an existing <br />21-inch sewer running north and south on Wellington Street. Mr. <br />Peddycord stated that LaSalle Square Associates was agreeable to <br />providing said easement to the city. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Hill and carried, the Board confirmed <br />the Vacation Resolution and ordered preparation of the Assessment <br />Roll to be filed on October 19, 1981. Mr. Leszczynski stated that <br />the Legal Department would prepare the necessary easement for <br />execution by LaSalle Square Associates. <br />n <br />
