369 <br />REGULAR MEETING SEPTEMBER 19, 1983 <br />Community.Development Department: <br />Vacating this alley will cause access problems for all <br />properties immediately adjacent to it (lots 5, 6, 88 <br />and 89). As said property owners have signed the <br />Petition to vacate, no objections. <br />Area Plan Commission: <br />The Staff of the Area Plan Commission has reviewed._ <br />this Petition and would recommend that this alley be <br />vacated, subject to any utility easements that may <br />be required and subject to a written access agreement <br />between the owners of lots 5, 6, 88 and 89 so that <br />access to the existing garages on lots 6 and 88 may <br />be maintained. <br />There being no one further wishing to speak for or. <br />against the proposed vacation, upon a motion made by <br />Mr. Leszczynski, seconded by Mr. Hill and carried, <br />the public hearing on this matter was closed. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill <br />and carried, the Clerk was instructed to forward a favorable <br />recommendation to the Common Council for the vacation of the <br />above mentioned alley, subject to the granting of agreements <br />of easements or conveyances of property between the above <br />mentioned affected property owners to permit total access to them <br />and subject to any and all utility easements. <br />AWARD BID AND APPROVE CONSTRUCTION CONTRACT - DOWNTOWN <br />PARKING LOT REPAIRS (RIETH-RILEY CONSTRUCTION CO., INC.) <br />In a letter to the Board, Mr. Neil Shanahan, Manager, Bureau <br />of Public Construction, recommended the Board award the low <br />bid of Rieth-Riley Construction Company, Inc., P.O. Box <br />1775, South Bend, Indiana, in the amount of $96,201.48. <br />Mr. Leszczynski advised that bids for this project were <br />opened on September 12, 1983. Mr. Leszczynski further <br />advised that in accordance with the award of this bid, a <br />contract in said amount was being submitted for Board <br />approval. Upon a motion made by Mr. Leszczynski, seconded <br />by Mr. Hill and carried, the above bid was awarded and <br />the contract approved. Accordingly, the appropriate <br />insurance, Performance Bond and Labor and Materials <br />Payment Bond submitted by Rieth-Riley Construction were <br />filed. <br />AWARD BID AND APPROVE CONSTRUCTION CONTRACT - SOUTH HAWTHORNE <br />ST. SANITARY SEWER PROJECT (H. DE WULF MECHANICAL CONTRACTOR) <br />In a letter to the Board, Mr. Neil A. Shanahan, Manager, <br />Bureau of Public Construction, recommended the Board award <br />the low bid of H. DeWulf Mechanical Contractor, Inc., <br />58600 Executive Drive, P.O. Box 936, Mishawaka, Indiana, <br />in the amount of $82,365.00. Mr. Leszczynski advised <br />that bids for this project were opened on September 12, <br />1983. Mr. Leszczynski further advised that in accordance <br />with the award of this bid, a contract in said amount <br />was being submitted for Board approval. Upon a motion <br />- <br />made by Mr. Leszczynski, seconded by Mr. Kernan and <br />carried, the above bid was awarded and the contract <br />approved. Accordingly, the appropriate insurance, <br />Performance Bond and Labor and Materials Payment Bond <br />submitted by H. DeWulf Mechanical Contractor, Inc. were <br />filed. <br />
