Indiana L-S Society) <br />Larry Dwyer (Bahai Faith) <br />Ms. Dobski, in response to a question from Mr. Kernan, indicated <br />that this year, applications for 43 food booths have been approved <br />as opposed to 39 last year. <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the above recommendations as presented were accepted <br />and approved. <br />APPROVE SIDEWALK SALE PERMIT APPLICATION '- CORNUCOPIA RESTAURANT <br />Mr. Leszczynski advised that a Sidewalk Sale Permit Application <br />has been received from Ms. Sharon Girten, 2870 Bender Drive, <br />Elkhart, Indiana, on behalf of the Cornucopia Restaurant, 303 <br />South Michigan Street, South Bend, Indiana, requesting permission <br />to sell beer and wine or fruit and fruit juices on July 2 & 3, <br />1983 during the Ethnic Festival. Ms. Girten was present at <br />the meeting and informed the Board that she has applied for a <br />Sunday sale permit from the State Alcoholic Beverage Commission <br />and has been told verbally that she will be granted a Sunday <br />sale permit to sell alcoholic beverages on the sidewalk only. <br />She was informed by them that she will not be allowed to sell <br />alcoholic beverages inside the restaurant on Sunday. <br />Mr. Hill advised that pursuant to I.C. 7.1-3-9-9, the sale of <br />alcoholic beverages on the public sidewalks from an open air <br />stand is prohibited. He stated that the Board of Public Works <br />cannot give permission to do something that is in conflict with <br />state law. It was noted that perhaps the State Alcoholic Beverage <br />Commission is granting dispensation from this restriction and will <br />grant a permit for this purpose. <br />It was noted that Ms. Girten has already provided the Board with <br />the appropriate $1,000,000.00 Certificate of Insurance naming <br />the City of South Bend as an additional insured for this purpose. <br />Upon a motion made by Mr. Hill, seconded by Mr. Leszczynski and <br />carried, the Board approved the Sidewalk Sale Permit Application <br />ofthe Cornucopia Restaurant to sell fruit and fruit juices on <br />July 2nd and 3rd and to sell beer and wine on those days subject <br />to the filing with the Board the appropriate documentation and <br />designation from the State ABC granting permission to conduct <br />the sale of alcoholic beverages from an open air stand on the <br />public sidewalk. <br />APPROVE LICENSE APPLICATIONS -OPEN AIR STANDS <br />Mr. Leszczynski advised that the following license applications <br />have been received: <br />KNUTE ROCKNE BABE RUTH <br />LARRY G..SNYDER <br />51333 Sandyridge <br />South Bend, Indiana <br />Stands to be located at: <br />
