16 <br />REGULAR MEETING <br />MA.Y 16. 1983 <br />inspection by the Department of Code Enforcement, no opaque <br />fencing will be required as the operation will be conducted <br />inside the building and the property does not abut public <br />property. The Fire Prevention Bureau will continue to. <br />inspect the premises as equipment is installed for the <br />operation of the station. Upon a motion made by Mr. Hill, <br />seconded by Mr. Kernan and carried, the above Resolution No. <br />12-1983 recommending Council approval of the issuance of the <br />license of STC Recycling, Inc. was adopted, and the Clerk was <br />instructed to prepare the necessary Council resolution for <br />final action by the Common Council for the issuance of this <br />license. <br />APPROVE PROJECT CHANGE ORDER NO. 1 (FINAL) AND PROJECT <br />COMPLETION AFFIDAVIT ARDMORE TRAIL STREET IMPROVEMENT <br />(WALSH & KELLY, INC.) <br />Mr. Leszczynski advised that Walsh & Kelly, Inc. had submitted <br />Change Order No. l (Final) indicating that the contract amount <br />be increased by $25,950.54 for a new contract sum including <br />this change order in the amount of $286,298.49. Additionally <br />submitted was the Project Completion Affidavit indicating <br />this new final cost. Upon a motion made by Mr. Leszczynski, <br />seconded by Mr. Hill and carried, Change Order No. 9 (Final) <br />and the Project Completion Affidavit were approved, subject <br />to the filing of :the appropriate three-year Maintenance Bond. <br />APPROVE CHANGE ORDER NO. 4 - ETHANOL PLANT SITE <br />DE -MUCKING (WOODRUFF & SONS, INC.) <br />Mr. Leszczynski presented to the Board Change Order No. 4 for <br />the ethanol plant site de -mucking. He stated that this Change <br />Order is a result of a change requested by Davy -McKee bring- <br />ing up to table -top the area which was below -grade. Finished <br />grades have.been changed as follows: The area 400 N to <br />Railroad and 4100 E to 4400 E Graded to elevation 713.0 and <br />the area 400 N to railroad and 4400 E to east property line <br />graded to .elevation 713.5. To compensate for the new higher <br />grades the stockpiled material has been decreased. Change <br />Order No. 4 indicates that the contract amount..be increased <br />by $14,765.25 for anew contract sum including.this Change <br />Order in the amount of $1,373,495.65. Upon a motion made <br />by Mr. Leszczynski, seconded by Mr. Hill and carried, the <br />above change order was approved. <br />APPROVE SOUTH BEND LIVERY HORSE AND CARRIAGE SERVICE <br />Mr. Leszczynski advised that the request of Ms. Lin Dowdy, <br />55455 Elder Road, Mishawaka, Indiana, owner of Rhapsody In <br />Bleau has been reviewed and favorable recommendations have <br />been received from the Park Department, Police Department, <br />Bureau of Traffic and Lighting, Legal Department and the <br />Health Department concerning this service. It was noted that <br />the horses are to be diapered and precautions are to be taken <br />for fly control. Additionally, all traffic signals and laws <br />are to be obeyed and the carriage must display a slow moving <br />vehicle sign. Minimum insurance requirements of not less than <br />$50,000.00 for injury to or destruction of property as a <br />result of any one occurrence and a public liability policy <br />covering accidental bodily injury, including death, to any <br />member of the public in an amount of not less than $100,000.00 <br />for all public liability from any one occurrence will be required. <br />Based on the favorable recommendations received, upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Hill and carried, the <br />request of Ms. Lin Dowdy to conduct a horse and carriage service <br />in the downtown area on Fridays and Saturdays from 4:00 p.m, to <br />12:00 a.m, and on Sunday afternoons was approved. <br />
