REGULAR MEETING APRIL 18. 1983 ADOPTION OF RESOLUTION NO. 9-1983 - RESCIND TRANSFER OF LAND FOR PARK PURPOSES, AS SET FORTH IN RESOLUTION NO. 14..1982 Mr. Hill advised the Board that the parcel of land previously transferred to the Park Department as part of the East Race Project had a discrepency in the legal description as a result of some differences in various surveys. The resolution presented to the Board at this time rescinds the transfer of land erroneously designated in Resolution No. 14, 1982. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the following Resolution No. 9-1983 rescinding the transfer of land for park purposes as set forth in Resolution No. 14, 1982 was adopted: RESOLUTION NO. 9-1983 RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND TO RESCIND TRANSFER OF LAND FOR PARK PURPOSES, AS SET FORTH IN RESOLUTION NO. 14, 1982 WHEREAS, the Board of Park Commissioners of the Park District of the City of South Bend on the 8th day of December, 1980, passed a declaratory resolution to acquire a parcel of property for the construction of a water related raceway, said parcel of property being referred to as Parcel IV - East Race; and WHEREAS, Resolution No. 14, 1982 was passed by the Board of Public Works on May 24, 1982, in an attempt to convey such property; and WHEREAS, said Resolution contained an erroneous designation of the real estate, said erroneous designation reading as follows: A parcel of land being all that part of the East Race located in the Northwest Quarter of Section 12, Township 37 North, Range 2 East in South Bend, Indiana, extending from the centerline of Colfax Avenue, Southerly to the St. Joseph River as conveyed to the Municipal City of South Bend, Indiana in Deed Record Book 671, Page 428 in the Office of the Recorder of St. Joseph County, Indiana and being more particularly described as follows,viz: Beginning at the point of intersection of the South right-of-way line of said Colfax Avenue with the Easterly line of said East Race, said beginning point being 167.64 feet North 890-52'-09" West of the intersection of said South right-of-way line with the West right-of-way line of Niles Avenue; thence South 40-50'-43" East, along an Easterly line of said East Race, a distance of 411.17 feet to a point on the North right-of-way line of Washington Street, 132.00 feet.North 890-45'-24" West from the Southeast corner of lot forty-eight (48) in the Original Plat to the Town of Lowell, now City.of South Bend; thence South 360-45'-32" East, along an Easterly line of said East Race, a distance of 103.30 feet to the South right- of-way line of said Washington Street; thence South 30-57'-43" East, along an Easterly line of said East Race, a distance of 293.37 feet to the Easterly meander line of the St. Joseph River; thence North 520-03'-45" West, along said Easterly meander line, a distance of 193.67 feet to a Westerly line of said East Race; thence North 520-57'-51" East, along said Westerly line, a distance of 32.89 feet; thence North 30-12'-46" East, along a Westerly line of said East Race, a distance of 8.90 feet; thence North 30-34'-50" West, along a Westerly line of said East Race, a distance of 228.50 feet to the point of intersection of said Westerly line with the South right-of-way line of Gintz Avenue; thence North 1 I 1
