137 <br />REGULAR MEETING <br />MARCH 7, 1983 <br />Mr. Hill advised that this resolution is a re-enactment of <br />Resolution 19-1981 originally adopted by the Board on October <br />9, 1981, authorizing the Department of Public Works to proceed <br />with preparations for off -site work and improvements in <br />regards to the ethanol plant project. Upon a motion made by <br />Mr. Leszczynski, seconded by Mr. Kernan and carried, the <br />above resolution was adopted. <br />ADOPTION OF RESOLUTION NO. 5-1983 - CONSTRUCTION OF STORM SEWER <br />ALONG CALVERT STREET WEST OF OLIVE STREET (ETHANOL PLANT PROJECT <br />RESOLUTION NO. 5-1983 <br />WHEREAS, the Board of Public Works has found it <br />necessary and in the best interests of the public <br />safety and welfare of the City of South Bend to <br />construct a storm sewer along Calvert Street west <br />of Olive Street and a ditch to connect said sewer <br />to the Kankakee Ditch; and, <br />WHEREAS, the Board of Public Works on March 7, 1983, <br />by Resolution authorized the preparation of necessary <br />design plans for such construction; and <br />WHEREAS, it has now become necessary to proceed by <br />condemnation for the acquisition of the real estate <br />herein described to carry forth such improvement. <br />NOW, THEREFORE, BE IT RESOLVED that the Board of <br />Public Works of the City of South Bend, hereby <br />directs and authorizes the doing of all acts necessary <br />and desirable to the acquisition by gift, exchange, <br />purchase or condemnation of the following described <br />real estate in St. Joseph County, Indiana. <br />A parcel of land situated in the Suthwest Quarter <br />W of Section Sixteen (16), Township Thirty-seven <br />(37) North, Range Two (2) East, in Portage Township, <br />St. Joseph County, Indiana, more particularly des- <br />cribed as follows: Beginning at a point in the <br />North and South centerline of the Northeast <br />Quarter of the Southwest Quarter of said Section <br />16, and said point being 50 feet Northwesterly <br />by radial measurement from the centerline of <br />the main Track of the New York Central Railroad <br />Company as described in Deed conveyance from <br />James H. Muir to the Indiana, Illinois and Iowa <br />Railroad Company by Quit -Claim Deed dated October <br />30, 1894, and recorded.in the office of the <br />Recorder of St. Joseph County, Indiana on. November <br />1, 1894; thence Southwesterly parallel to said <br />centerline a distance of 1970 feet, more or less, <br />to the East and West centerline of said Southwest <br />Quarter of said Section 16; thence West along the <br />said East and West centerline a distance of 74 <br />feet, more or less, to a point 100 feet North- <br />westerly by radial measurement from: -the said <br />centerline of the main track of the New York <br />Central Railroad Company; thence Northeasterly <br />parallel to said centerline a distance of 1980 <br />feet, more or less, to the East and West center- <br />line of said Section 16; thence East along said <br />East and West centerline of said Section 16 a <br />distance of 24 feet more or less to a point, <br />said point being 43.9 feet West of the North <br />and South centerline of the said Northeast <br />Quarter of the said Southwest Quarter of said <br />Section 16, measured along said East and West <br />
