J-2 2 <br />REGULAR MEETING <br />FEBRUARY 14, 1983 <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan <br />and carried, the above Order was filed with the Board. Mr. <br />Leszczynski stated that appropriate action to comply with the <br />mandate will now be taken. <br />ADOPT IMPROVEMENT RESOLUTION NO. 3518, 1983 (RIVERSIDE <br />DRIVE - RIVERSIDE PLACE SANITARY SEWER PROJECT) <br />Mr. Leszczynski stated that in response to the mandate received <br />from the St. Joseph County Health Department, the Engineering <br />Department has prepared Improvement Resolution No. 3518, 1983, <br />the preliminary assessment roll and plans and engineer's <br />estimate for the project. The total cost of the Improvement <br />is $89,353.85, with an amount assessed to the City of <br />$57,177.01. Upon a motion made by Mr. Leszczynski, seconded <br />by Mr. Hill and carried, the above documents were filed and <br />the following Improvement Resolution No. 3518, 1983 was <br />adopted and set for public hearing on February 2�, 1983: <br />IMPROVEMENT RESOLUTION NO. 3518, 1983 <br />BE IT RESOLVED, by the Board of Public Works of the City <br />of South Bend, Indiana, that it is deemed necessary to <br />improve the sanitary conditions along Riverside Drive <br />and Riverside Place by constructing an.8" diameter sanitary <br />sewer in said streets. <br />The same to be done in accordance with the profiles, draw- <br />ings, general details and specifications for such improve- <br />ments approved February 14, 1983, and to be adopted by the <br />Board of Public Works of the City of South Bend, Indiana, <br />immediately upon the final adoption and confirmation of <br />this Resolution, and placed on file in the office of the <br />Board of Public Works of said City, and such improve- <br />ment is now ordered. <br />The total cost of said improvement, including all <br />incidental costs, such as advertising and engineering, <br />shall be assessed upon the real estate abutting on said <br />Riverside Drive and Riverside Place, in accordance with <br />applicable statutes. The said improvement is to be <br />financed and paid for as provided in I.C.-36-9-21. <br />Assessments, if deferred, are to be paid with interest <br />at the rate of ten (10) per cent per annum. <br />The 28th day of February, 1983 at the hour of 9:30 a.m. <br />o'clock, Local Time, is hereby fixed as the time and the <br />Board of Public Works Hearing Room 1308 as the place when <br />and where all interested persons shall be heard on the <br />question of special benefits and on any other matter <br />pertaining to the proposed sewage works. The Board will, <br />on said day, decide whether the benefits accruing to <br />abutting and adjacent property, and to the City of South <br />Bend, Indiana, will be equal to or exceed the estimated <br />cost of said improvement.
