J-2 2 REGULAR MEETING FEBRUARY 14, 1983 Upon a motion made by Mr. Leszczynski, seconded by Mr. Kernan and carried, the above Order was filed with the Board. Mr. Leszczynski stated that appropriate action to comply with the mandate will now be taken. ADOPT IMPROVEMENT RESOLUTION NO. 3518, 1983 (RIVERSIDE DRIVE - RIVERSIDE PLACE SANITARY SEWER PROJECT) Mr. Leszczynski stated that in response to the mandate received from the St. Joseph County Health Department, the Engineering Department has prepared Improvement Resolution No. 3518, 1983, the preliminary assessment roll and plans and engineer's estimate for the project. The total cost of the Improvement is $89,353.85, with an amount assessed to the City of $57,177.01. Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and carried, the above documents were filed and the following Improvement Resolution No. 3518, 1983 was adopted and set for public hearing on February 2�, 1983: IMPROVEMENT RESOLUTION NO. 3518, 1983 BE IT RESOLVED, by the Board of Public Works of the City of South Bend, Indiana, that it is deemed necessary to improve the sanitary conditions along Riverside Drive and Riverside Place by constructing an.8" diameter sanitary sewer in said streets. The same to be done in accordance with the profiles, draw- ings, general details and specifications for such improve- ments approved February 14, 1983, and to be adopted by the Board of Public Works of the City of South Bend, Indiana, immediately upon the final adoption and confirmation of this Resolution, and placed on file in the office of the Board of Public Works of said City, and such improve- ment is now ordered. The total cost of said improvement, including all incidental costs, such as advertising and engineering, shall be assessed upon the real estate abutting on said Riverside Drive and Riverside Place, in accordance with applicable statutes. The said improvement is to be financed and paid for as provided in I.C.-36-9-21. Assessments, if deferred, are to be paid with interest at the rate of ten (10) per cent per annum. The 28th day of February, 1983 at the hour of 9:30 a.m. o'clock, Local Time, is hereby fixed as the time and the Board of Public Works Hearing Room 1308 as the place when and where all interested persons shall be heard on the question of special benefits and on any other matter pertaining to the proposed sewage works. The Board will, on said day, decide whether the benefits accruing to abutting and adjacent property, and to the City of South Bend, Indiana, will be equal to or exceed the estimated cost of said improvement. The Clerk of the Board is hereby ordered to give notice by one publication at least ten days prior to hearing of this Resolution. Adopted: February 14, 1983.
