410 <br />REGULAR MEETING <br />OCTOBER 22. 1984 <br />APPROVE TITLE SHEETS - IRISH HILLS APARTMENTS AND WESTERN <br />AVENUE PARKING LOTS PROJECT <br />Mr. Leszczynski advised that Title Sheets for Irish Hills Apart- <br />ments for Edward Rose of Indiana, 6100 Newport Road, Portage, <br />Michigan, and the Western Avenue Parking Lots Project were being <br />presented at this time for execution. Upon a motion made by <br />Mr. Leszczynski, seconded by Mr. Vance and carried, the above <br />referred to Title Sheets were approved and signed. <br />APPROVE TRAFFIC CONTROL DEVICE <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Hill and <br />carried, the following one (1) traffic control device was approved: <br />INSTALL TEMPORARY 1 PARKING SPACE - 100 W. Jefferson - <br />Federal Bldg. (for 30 days for General Services <br />Administration). <br />APPROVE CONTRACTOR'S BOND <br />Mr. Melvin Humphrey, Engineering Department, recommended that the <br />Contractor's Bond for R.A. Lange Construction Co., Inc., be <br />approved effective October 22, 1984. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Hill and carried, the above <br />Contractor's Bond was approved. <br />FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORT <br />A report from the Department of Code Enforcement indicating a <br />total of seventy-six (76) properties cleaned from October 15, 1984 <br />to October 19, 1984 was submitted. Upon a motion made by Mr. <br />Leszczysnki, seconded by Mr. Vance and carried, the report as <br />submitted was filed. <br />APPROVE CLAIMS <br />Ms. Jane Cleaver, Executive Director, St, Joseph County Job <br />Training Program, submitted a list containing forty-five (45) <br />claims and recommended approval. Additionally, City Controller <br />Michael L. Vance submitted Claim Docket No. 19794 through Claim <br />Docket No. 20491 and recommended approval. Upon a motion made <br />by Mr. Leszczynski, seconded by Mr. Hill and carried, the claims <br />were approved and the reports as submitted were filed. <br />PRIVILEGE OF THE FLOOR <br />FILING OF PETITION REGARDING THE LOCATION OF A SOFT <br />DRINK MACHINE AT 2011 ELWOOD AVENUE <br />Mrs. Rebecca A. Niedbalski, 2009 Elwood Avenue, South Bend, <br />Indiana, was present at the meeting and addressed the Board. <br />Mrs. Niedbalski submitted to the Board for filing a Petition <br />signed by fourteen (14) individuals, said Petition requesting <br />that the City of South Bend declare the soft drink vending machine <br />located on the premises of L.E.S. Distributing, 2011 Elwood Avenue, <br />South B=end, Indiana, a public nuisance. During the period, October <br />7-14, 1984, the vending machine was broken into not less than three. <br />(3) times and police records reveal that this is not an uncommon <br />occurrence. The residents believe that this machine, due to its <br />location and vulnerability, invite a criminal element to the <br />neighborhood and endanger their lives and property. <br />Mrs. Niedbalski advised that the individuals who own L.E.S. <br />Distributing do not live on the premises and are not bothered <br />by the noise, nuisance and vandalism as are the other residents <br />of the neighborhood. In response to a question from Mr. Hill, <br />Mrs. Niedbalski advised that L.E.S. Distributing is an electronics <br />business with the entrance to the business being in the rear. The <br />soft drink vending machine in question is located in front of <br />the establishment. <br />1 <br />1 <br />1 <br />
