N <br />REGULAR MEETING NOVEMBER 7. 1983 <br />In response to Mr. Hill's questions regarding the burglary <br />charge, Mr. Colley advised that the penalty for the crime <br />was one to ten years and that he served one and one-half <br />years at Pendleton. He stated that he was seventeen years <br />of age at that time. <br />Mr. Hill advised Mr. Colley that the basis of the denial of <br />the application was the fact that on the application he <br />indicated that he had never been convicted of a crime. The <br />Police Department background check, however, reflects in <br />addition to the 1967 sentence that he had ,a public intoxica- <br />tion arrest in 1969, an assault and battery charge in 1970 <br />and a malicious trespassing charge in 1971. Also, there <br />was a disorderly conduct charge,in November of 1971, and <br />a 1974 arrest for driving under the influence. Mr. Hill <br />pointed out.that all of these charges should have been <br />listed on the application. <br />Mr. Colley stated that he just _couldn't remember back that <br />far. He reiterated that the 1967 arrest was when he was <br />a minor and he did not think it had to be listed and did not <br />think it would still appear on his record. He further <br />stated that his last drinking related incident was eight <br />years ago. <br />Mr. Hill acknowledged that Mr. Colley's record does reflect <br />that at least since 1975 he has not had any problems. Mr. <br />Hill stated that if the Board were willing to grant the <br />license, that Mr. Colley be aware that if there are any <br />future offenses for driving under the influence or any <br />other offense of that type, the Board would be in a position <br />to revoke the license. Mr. Hill stated that the Board <br />acknowledges that Mr. Colley has had problems in the past <br />but has made an effort to correct those problems. <br />Mr. Colley advised that he has received a degree in welding <br />and had attended Alcoholics Anonymous for awhile. <br />Upon a motion made by Mr. Hill, seconded by Mr. Leszczynski <br />and carried, the taxi driver's license application of Mr. <br />Colley was approved- Mr. Kernan abstained from voting. <br />AWARD BID - REPAIRS AND REMODELING FOR HOUSE/POLICE <br />SUBSTATION AT 420 NORTH FRANCES STREET <br />In a letter to the Board, Mr. Neil A. Shanahan, Manager, <br />Bureau of Public Construction, recommended the Board <br />accept the bid of Van Overberghe Builders, Inc., 57440 <br />Peggy Drive, South Bend, Indiana, in the amount of <br />$22,950.00 for the above referred to project. Mr. <br />Leszczynski advised that bids for this project were opened <br />at the Board meeting held on September 26, 1983. Upon a <br />motion made by Mr. Leszczynski,_ seconded by Mr. Hill and <br />carried., the above bid was awarded. <br />APPROVE REQUEST FOR CLOSURE OF A PORTION OF <br />WASHINGTON STREET FOR VETERANS DAY ACTIVITIES <br />In a letter, Mr. Harold "Red" Conery, Chairman, St. Joseph <br />County Veterans Commanders' Council, 1313 Portage, South <br />Bend, Indiana, indicated that plans are being finalized <br />for the observance of Veteran's Day on Friday, November <br />11, 1983. The Celebration will be held at 10:45 a.m. in <br />front of the monument located north of the Old Courthouse <br />at the corner of Main and Washington Streets. As in past <br />years, it is requested that the middle and south lanes <br />of Washington Street from Main Street to Lafayette <br />Boulevard, be blocked off for this event. Upon a motion <br />made by Mr. Leszczynski, seconded by Mr. Hill and carried, <br />the above request was approved. <br />
