REGULAR MEETING <br />NOVEMBER 7. 1983 <br />PUBLIC HEAPING AND DENIAL - TAXI DRIVER'S LICENSE <br />APPLICATION (ROBERT MC CAMMON) <br />Mr. Robert N. McCammon, 914 Bellevue, South Bend, Indiana, <br />appeared before the Board concerning the October 31, 1983 Board <br />denial of his application for a taxi driver's license. <br />Mr. Hill advised Mr. McCammon that on the application he <br />indicated "no" to the question which asked have you ever been <br />convictedofa crime. However, a Police Department background <br />check indicated that Mr. McCammon has had convictions. <br />Mr. McCammon stated that he does not consider public intoxica- <br />tion a crime and he indicated that he was aware that a back- <br />ground check would be conducted. He further stated that his <br />public intoxication had nothing to do with driving and that he <br />has never had a problem while driving. Mr. McCammon indicated <br />that he has been driving a taxi for four years but is not <br />driving now pending the outcome of this hearing. <br />Mr. Hill stated that the background check indicates that Mr. <br />McCammon was arrested on September 11, 1983 for speeding and <br />on August 3, 1983 for public intoxication. <br />Mr. McCammon.advised that he was driving a taxi cab at the time <br />he was arrested for speeding. However, he further stated that <br />he never drinks when driving a cab and again reiterated that he <br />does not consider public intoxication a crime. <br />Mr. Hill advised that the concern of the Board is that the police <br />record indicated that Mr. McCammon does have a problem with <br />drinking. From 1973 to the present there are approximately nine <br />(9) public intoxication charges against Mr. McCammon. <br />Mr. McCammon stated that he was unaware that he had been arrested <br />that many times for public intoxication but stated that he never <br />went near a taxi cab when intoxicated. <br />Mr. Hill informed Mr. McCammon that the police background check <br />indicates that in 1977 he was arrested for driving under the <br />influence and reckless driving. Mr. Hill stated that if there <br />had been a long period of time without a public intoxication <br />arrest and if in fact Mr. McCammon had gotten himself some <br />help and avoided these reoccurrences, then the Board would <br />consider granting him a license. However, Mr. Hill stated that <br />it was his feeling that the Board could not grant Mr. McCammon <br />a license because of an apparent drinking problem. Mr. Hill <br />advised Mr. McCammon that he could come before the Board in <br />the future, perhaps in six months or a year and the Board would <br />reconsider the application at that time. <br />Upon a motion made by Mr. Hill, seconded by Mr. Leszczynski and <br />carried, the above license for Robert McCammon was denied. Mr. <br />Kernan abstained from voting on this matter. <br />PUBLIC HEARING AND APPROVAL - TAXI DRIVER'S LICENSE <br />APPLICATION (ALLEN COLLEY) <br />Mr. Allen LaMar Colley, 2715 W. Ewing Street, Mishawaka, Indiana, <br />appeared before the Board concerning the October 31, 1983, Board <br />denial of his application for a taxi driver's license. <br />Mr. Colley advised that he had a "driving under the influence" <br />charge in 1975 which was eight years ago. He stated that he <br />has not had any incidents since that time. He further advised <br />that twenty years ago, when he was sixteen years of age, he was <br />involved in a burglary and was convicted of being an accomplice <br />to the crime. He stated that he did not indicate this on the <br />application as he did not think it was still on his record. <br />C' <br />1 <br />1 <br />
