C)� <br />REGULAR MEETING OCTOBER 21, 1985 <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATION: 1ST <br />E/W ALLEY SO. OF SOUTH BEND_AVENUE.RUNNING NORTHEASTERLY FROM THE <br />EAST RIGHT-OF-WAY OF JACOB STREET <br />Mr. Leszczynski advised that this was the date set..for the..., <br />Board's Public Hearing on a proposed alley vacation described--as--- <br />the first fourteen (14) foot east/west alley, south of South Bend <br />Avenue, running northeasterly from the east right-of-way of Jacob <br />Street, for a distance of 167.5 feet more or less to a dead-end,. <br />abutting lots 1, 2, and 3 of Parker and Allens Addition and Lot S <br />of Parker and Allens Replat, City of South Bend,. St —Joseph <br />County, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition file d,by- Mr.,_.John Firth, <br />Attorney at Law, So ko & Associates, Box 928,'S <br />P South Bend, <br />Indiana, on beha.lf,of his clients Jack. -and -Lois Powell,, 1713 <br />South Bend Avenue, South Bend, Indiana. It was further noted <br />that pursuant to South Bend Municipal Code Section 18.53.8, <br />owners whose property abut the proposed alley to be vacated were <br />notified.of the Board's Public Hearing date. <br />Mr. John Firth, Attorney at Law, 419 West Jefferson Boulevard, <br />South Bend, Indiana, representing Jack and Lois Powell, 1713 <br />South Bend Avenue, South Bend, Indiana, was present and advised <br />the Board that the intention of the vacation is to consolidate <br />lots. He further advised that his clients own most of the <br />abutting property and that they propose toconstruct an office <br />building and garage on the area. It was noted that the proposed <br />alley to be vacated is a dead-end alley. <br />There being;no.one.else present wishing to speak either for -or <br />against the proposed alley" -vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Ms. Barnard and carried, the Public <br />Hearing on this matter was closed. <br />Mr. Leszczynski advised that favorable comments have been <br />received from the.:Engineering Department -and Area -Plan Commission_. <br />concerning this proposed alley vacation. <br />Therefore, upon a motion made by Ms. Barnard, seconded by Mr._ <br />Vance and carried, the Clerk was instructed to forward to the <br />Common Council, a "favorable .recommendation on the above .referred . . <br />to alley vacation subject to any and all utility easements. <br />AWARD BID AND APPROVE <br />CONSTRUCTION CONTRACT AND CHANGE ORDER <br />NO. 1 - RESTORATION OF THE PALAIS ROYALE BUILDING (FACADE AND <br />SIDEWALK) PROJECT <br />Mr. Leszczynski advised that James E. Childs & Associates, Inc. <br />has reviewed the bids received on September 30, 1985 for the <br />above referred to project, and recommends that the Board award <br />the low bid of Harry H. Verkler, Contractor, 645 North Wilber <br />Street, South Bend, Indiana, in the amount of $258,632.00. It <br />was noted that this amount is the base bid of $281,544.00 plus <br />alternate bid No. 4 which is an addition of $2,750.00 and <br />alternate .bid No. 5 which is a deduct of $25,662.00. <br />Additionally submitted for approval was the Standard Form of <br />Agreement Between Owner and Contractor in the amount of <br />$258,632.00 as well as Change Order No. 1 indicating that the <br />contract amount be decreased by $75,632-.00 thereby bringing the <br />new contract amount to $183,000.00. The Change Order indicates._ <br />changes in six (6) contract items. <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard <br />and carried, the bid was awarded and the Contract and Change <br />Order No. 1 approved, subject to the filing of the appropriate <br />Performance Bond and Labor and Materials Payment Bond and. <br />Certificate of Insurance. <br />a <br />Ili <br />
