REGULAR MEETING <br />NOVEMBER 10, 1986 <br />The regular meeting of the Board of Public Works was convened at <br />9:34 a.m. on Monday, November 10, 1986, by President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq <br />and Mr. Michael L. Vance present. Also present was Assistant <br />City Attorney Carolyn V. Pfotenhauer. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Vance, and <br />carried, the minutes of the November 3, 1986, regular meeting of <br />the Board were approved. <br />POSTPONEMENT OF PUBLIC HEARING REGARDING FINAL ASSESSMENT ROLL <br />NO. 2993 - CONSTRUCTION OF SANITARY SEWER ALONG RIVERSIDE DRIVE <br />AND RIVERSIDE PLACE <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing for the purpose of hearing and considering <br />all remonstrances as to the amounts assessed on Final Assessment <br />Roll No. 2993 for the above referred to project as authorized <br />under Improvement Resolution No. 3522-86 adopted by the Board on <br />February 18, 1986. However, as the time of the Public Hearing <br />was inadvertently omitted from the Notice of Public Hearing <br />published in the newspaper and from the Notice of Public Hearing <br />sent to affected property owners, the Board cannot go ahead with <br />the Public Hearing today. Therefore, Mr. Leszczynski made a <br />motion that the Notice of Public Hearing be readvertised and <br />affected property owners be sent new Notices of a Public Hearing <br />which will be held on November 25, 1986 at 9:30 a.m. Mr. Vance <br />seconded the motion and it carried. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATIONS: <br />ENTIRE N/S ALLEY, ALSO WEST .1/2 OF THE E/W ALLEY WITHIN THE BLOCK <br />BOUNDED BY MONROE-MAIN-SOUTH AND LAFAYETTE STREETS <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on the proposed vacation of the following <br />alleys: <br />The entire north/south alley ALSO the west 1/2 (one-half) of <br />the east/west alley within the city block bounded by: <br />Monroe -Main -South and Lafayette Streets in Martins Add. to <br />the City of South Bend, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Joseph J. Pluta, <br />Director, City of South Bend, Division of Engineering, Room 1316 <br />County -City Building, South Bend, Indiana. It was further noted <br />that pursuant to South Bend Municipal Code Section 18-53.8, <br />owners whose property abut the proposed alleys to be vacated were <br />notified of the Board's Public Hearing date. <br />Mr. Joseph J. Pluta, Director, City of South Bend, Division of <br />Engineering, was present and advised the Board that the purpose <br />of the vacation of the above referred to alleys abutting and <br />adjacent to the Studebaker Museum is for security and <br />improvements to the property and asked that the Board favorably <br />consider this vacation. <br />Mr. Gregory Bajer, 1211 Dodge, Mishawaka, Indiana, addressed the <br />Board and advised that he was present on behalf of Ms. Jule Bell, <br />210 West Monroe, Elkhart, Indiana, an abutting property owner. <br />He stated that Ms. Bell owns Lots No. 43, 44 and 45 at the <br />northeast corner of the north/south alley to be vacated and with <br />the closing of the alley, access to the furnace room at the rear <br />of a building at that location and use of the alley for <br />deliveries would be cut-off. <br />
