REGULAR MEETING SEPTEMBER 23, 1986 <br />Cu <br />APPROVE CLAIMS <br />Mr. John W. Ferguson, Executive Director, St. Joseph County Job <br />Training Program submitted two (2) lists containing one hundred <br />sixty-eight (168) claims and recommended approval. Additionally, <br />Deputy City Controller Carol M. Sanders submitted Claim Docket <br />No. 024993 through Claim Docket No. 025682 and recommended <br />approval. Upon a motion made by Mr. Vance, seconded by Ms. <br />Barnard and carried, the claims were approved and the reports as <br />submitted were filed. <br />PRIVILEGE OF THE FLOOR <br />FILING OF PETITION FROM RESIDENTS OF 800-1200 BLOCKS OF WEST <br />NAPIER STREET TO REPAIR AND PAVE STREETS OF SAID BLOCKS <br />Mr. Silas West, 812 West Thomas Street, South Bend, Indiana, <br />submitted to the Board a Petition signed by the residents of the <br />800, 900, 1000, and 1200 blocks of West Napier Street requesting <br />the repair, upgrading and paving of streets in said blocks of <br />West Napier Street. <br />Mr. West stated that this is not the first time the residents <br />have come to the Board with this request. Last year residents <br />were told the City ran out of money to do this type of work and <br />residents now request that something be done immediately to <br />correct the condition of the streets in the area referred to <br />above. He further stated that the manholes in the street have <br />dropped three (3) to four (4) inches and are a hazard to <br />vehicles. <br />Mr. West additionally informed the Board that the Contractor <br />hired by the City to do curb and sidewalk repair work in the area <br />did a good job and finished the project approximately two (2) <br />weeks ago. However, they did not remove the excess concrete and <br />the youth of the neighborhood have been throwing the pieces of <br />concrete left behind by the Contractor. Mr. Joseph J. Pluta, <br />Director, Division of Engineering, was present and advised that <br />he will contact the Contractor and advise him of the problem with <br />excess concrete remaining at the site. <br />Further, Mr. West stated that on September 22, 1986, lightning <br />struck the tree located on the treelawn area in front of his <br />residence and a large limb is lying on the sidewalk. He inquired <br />whose responsibility it was to remove the limb. Ms. Barnard <br />advised Mr. West that even through the treelawn area is <br />considered public right-of-way, it is the property owner's <br />responsibility to maintain and therefore it is his responsibility <br />to see that the limb is removed and that the tree does not create <br />a hazardous condition to pedestrians. <br />Therefore, upon a motion made by Mr. Vance, seconded by Ms. <br />Barnard and carried, the Petition as submitted was referred to <br />the Engineering Department and the Department of Economic <br />Development for review and consideration. <br />ADJOURNMENT <br />There being no further business to come before the Board, upon a <br />motion made by Ms. Barnard, seconded by Mr. Vance and carried, <br />the meeting adjourned at 9:57 a.m. <br />KA, A d ___0 <br />Katherine G.
