Pluta, Director, Division of Engineering, advised <br />that the Easement and Right -of -Way for property known as the <br />north twenty (20) feet of Lots 261-262 and 263 of Bowman's 6th <br />Add. to the City of South Bend, St. Joseph County, Indiana, <br />submitted by Mr. Raymond Mohlman, 126 East Fox Street, South <br />Bend, Indiana, allows the City to make improvements to the open <br />concrete ditch that exists at the southwest corner of St. Joseph <br />and Fox Streets. It is anticipated that the ditch will be <br />filled -in thus allowing the creek to flow underground. <br />Therefore, upon a motion made by Ms. Barnard, seconded by Mr. <br />Vance and carried, the Easement was accepted and approved. <br />ADOPT RESOLUTION NO. 22-1986 RESCINDING RELEASE OF RIGHTS AND <br />EASEMENTS TO CONSTRUCT AND MAINTAIN FACILITIES AS GRANTED ON <br />AUGUST 19, 1986 AND APPROVE AND ACCEPT NEW RELEASE OF RIGHTS AND <br />EASEMENTS TO CONSTRUCT AND MAINTAIN FACILITIES (COVELESKI <br />REGIONAL STADIUM PROJECT) <br />Board Attorney Thomas Bodnar advised that due to an incorrect <br />legal description contained in the Release of Rights and <br />Easements approved by the Board on August 19, 1986, it is <br />necessary at this time to rescind said Release and adopt a new <br />Release with the correct legal description. Therefore, upon a <br />motion made by Ms. Barnard, seconded by Mr. Vance and carried, <br />Resolution No. 22-1986 rescinding the Release of Rights and <br />Easements approved on August 19, 1986 was adopted and approved. <br />Further, upon a motion made by Ms. Barnard, seconded by Mr. Vance <br />and carried, a new Release of Rights and Easements to Construct <br />and Maintain Facilities as it relates to the Stanley Coveleski <br />Regional Stadium Project was approved.
