REGULAR MEETING SEPTEMBER 23, 1986 LOCATION: OWNER: APPRAISED VALUE: OFFERING PRICE: 614 East Indiana Avenue First Interstate Bank as Executor of the Estate of Violet Schang $5,500.00 $5,500.00 Upon a motion made by Mr. Vance, seconded by Ms. Barnard and carried, the Offer to Purchase Real Property as submitted was approved and executed. ACCEPT AND APPROVE EASEMENT AND RIGHT-OF-WAY - NORTH 20 FEET OF LOTS 261-262 AND 263 OF BOWMAN'S 6TT4 Ann_ Mr. Joseph J. Pluta, Director, Division of Engineering, advised that the Easement and Right -of -Way for property known as the north twenty (20) feet of Lots 261-262 and 263 of Bowman's 6th Add. to the City of South Bend, St. Joseph County, Indiana, submitted by Mr. Raymond Mohlman, 126 East Fox Street, South Bend, Indiana, allows the City to make improvements to the open concrete ditch that exists at the southwest corner of St. Joseph and Fox Streets. It is anticipated that the ditch will be filled -in thus allowing the creek to flow underground. Therefore, upon a motion made by Ms. Barnard, seconded by Mr. Vance and carried, the Easement was accepted and approved. ADOPT RESOLUTION NO. 22-1986 RESCINDING RELEASE OF RIGHTS AND EASEMENTS TO CONSTRUCT AND MAINTAIN FACILITIES AS GRANTED ON AUGUST 19, 1986 AND APPROVE AND ACCEPT NEW RELEASE OF RIGHTS AND EASEMENTS TO CONSTRUCT AND MAINTAIN FACILITIES (COVELESKI REGIONAL STADIUM PROJECT) Board Attorney Thomas Bodnar advised that due to an incorrect legal description contained in the Release of Rights and Easements approved by the Board on August 19, 1986, it is necessary at this time to rescind said Release and adopt a new Release with the correct legal description. Therefore, upon a motion made by Ms. Barnard, seconded by Mr. Vance and carried, Resolution No. 22-1986 rescinding the Release of Rights and Easements approved on August 19, 1986 was adopted and approved. Further, upon a motion made by Ms. Barnard, seconded by Mr. Vance and carried, a new Release of Rights and Easements to Construct and Maintain Facilities as it relates to the Stanley Coveleski Regional Stadium Project was approved. Resolution No. 22-1986 is as follows: RESOLUTION NO. 22-1986 RESOLUTION OF THE BOARD OF PUBLIC WORKS TO RESCIND RELEASE OF RIGHTS AND EASEMENTS TO CONSTRUCT AND MAINTAIN FACILITIES AS GRANTED ON AUGUST 19, 1986 WHEREAS, the Board of Public Works of the City of South Bend on the 19th day of August, 1986, passed a Release of Rights and Easements concerning certain property in the area in which the Stanley Coveleski Regional Stadium Project was being constructed; and WHEREAS, said release included an improper description of the real estate involved, said improper description reading as follows: A part of Vail's Southwest Addition to South Bend as shown on the Recorded Plat thereof in the St. Joseph County, Indiana, Recorder's Office, more particularly described as follows:
