REGULAR MEETING <br />SEPTEMBER 9, 1986 <br />�10 3 <br />1 <br />1 <br />1 <br />The regular meeting of the Board of <br />9:38 a.m. on Tuesday, September 9, <br />Leszczynski, with Mr. Leszczynski, <br />and Mr. Michael L. Vance present. <br />City Attorney Thomas Bodnar. <br />PUBLIC HEARING RE: HER <br />Public Works was convened at <br />1986, by President John E. <br />Ms. Katherine G. Barnard <br />Also present was Chief Deputy <br />ION REQUEST FOR BASIC SERVICE <br />RATE INCREASE CANCELLED AND STRICKEN FROM THE AGENDA <br />Mr. Leszczynski advised that Heritage Cablevision has withdrawn <br />their request for a basic rate increase of $1.50 as originally <br />requested on July 29, 1986 and has imposed a 5% rate increase, <br />without Board of Public Works approval, which is allowable under <br />current statutes. <br />As a point of clarification, Ms. Barnard stated that basically <br />Heritage Cablevision bypassed the Board in this matter at this <br />time. <br />In response to a citizen who was present.and advised that he <br />received notification from Heritage Cablevision that his monthly <br />rate would be increased $.62, Mr. Vance stated that that $.62 is <br />the 5% rate increase that Heritage has authority to implement <br />without permission from the Board of Public Works. He further <br />advised that at the end of this year the Board of Public Works <br />will have no jurisdiction in this matter. <br />Further, Board Attorney Thomas Bodnar advised that by an act of <br />Congress the laws concerning the regulation of cablevision rates <br />has changed. It was noted that perhaps the Federal <br />Communications Commission has some authority in this type of <br />matter. <br />Mr. Vance stated that federal statutes have been amended which no <br />longer gives cities control over cablevision rates. Mr. Vance <br />also advised the citizen inquiring about the rate increase that <br />the City would welcome any other cablevision companies but at <br />this time there are no other cablevision companies in the area. <br />Reiterating, Mr. Vance advised that as of January 1, 1987, the <br />City will have no authority in the matter of rate increases. <br />Therefore, upon a motion made by Mr. Leszczynski, seconded by Ms. <br />Barnard and carried, the Public Hearing regarding Heritage <br />Cablevision's request for basic service rate increase was <br />cancelled and the matter was stricken from the agenda. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard <br />and carried, the Title Sheet for the Architectural/MEP Package <br />for the Stanley Coveleski Regional Baseball Stadium Project was <br />added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mr. Leszczynski, seconded by Mr. Vance, and <br />carried, the minutes of the September 2, 1986, regular meeting of <br />the Board were approved. <br />OPENING OF BIDS - MICHIGAN STREET IMPROVEMENTS - PHASE II PROJECT <br />This was the date set for receiving and opening of sealed bids <br />for the above referred to project. The Clerk tendered proofs of <br />publication of Notice in the South Bend Tribune and the <br />Tri-County News which were found to be sufficient. It was noted <br />that the Engineer's Estimate for this project is $864,000.00. <br />The following bids were opened and publicly read: <br />
