REGULAR MEETING <br />JULY 1, 1986 <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION <br />E/W ALLEY NO. OF L.W.W. RUNNING W. FROM SHE <br />Mr. Leszczynski advised that this was the d <br />Board's Public Hearing on a proposed alley <br />the lst east/west alley north of Lincolnway <br />from Sheridan to Knoblock for a distance of <br />in Post Place Addition to the City of South <br />County, Indiana. <br />- ALLEY VACATION: 1ST <br />ate set for the <br />vacation described as <br />West running West <br />299 feet + all being <br />Bend, St. Joseph <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Steve Becsei, 1615 <br />North Sheridan Street and Mr. Thomas A. Osborn, 1616 Knoblock <br />Street, South Bend, Indiana. It was further noted that pursuant <br />to South Bend Municipal Code Section 18-53.8, owners whose <br />property abut the proposed alley to be vacated were notified of <br />the Board's Public Hearing date. <br />Mr. Thomas A. Osborn, 1616 Knoblock, South Bend, Indiana, <br />Petitioner, was present and addressed the Board. Mr. Osborn <br />stated that he is in favor of the alley being vacated as it <br />currently is being used like a street. The closing of the alley <br />would assure the safety of the residents and children in the <br />neighborhood. <br />Mr. Steve Becsei, 1615 North Sheridan Street, South Bend, <br />Indiana, Petitioner, was also present and advised the Board that <br />the alley is being used to dump garbage and trash and he is also <br />in favor of the alley being closed to alleviate this problem. <br />Mr. Osborn stated that the only other abutting property owner <br />lives in Illinois but has advised him, in writing, that he is in <br />favor of the vacation. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Ms. Barnard and carried, the Public <br />Hearing on this matter was closed. <br />Mr. Leszczynski advised that favorable comments have been <br />received from the Engineering Department, Area Plan Commission <br />and the Community Development Department concerning this proposed <br />alley vacation. <br />Mr. Vance suggested to Mr. Osborn that he provide to the Board, <br />for its file, the letter from the other abutting property owner <br />stating that he is in favor of the vacation. Mr. Osborn stated <br />that he submitted that letter to the City Clerk's Office when he <br />filed the petition to vacate. The Clerk of the Board was <br />therefore, requested to secure a copy of that letter for the <br />Board's files. <br />Therefore, upon a motion made by Mr. Vance, seconded by Ms. <br />Barnard and carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation on the above referred <br />to alley vacation subject to any and all utility easements. <br />APPROVE COMMUNITY DEVELOPMENT CONTRACT AND ADDENDUM <br />The following Community Development Contract and Addendum were <br />presented to the Board for approval: <br />LINCOLNWAY WEST BUSINESS ASSOCIATION <br />LINCOLNWAY WEST MARKET STUDY ACTIVITY <br />The targeted goal for this activity is to conduct a market <br />study of the Lincolnway West commercial strip. The total <br />cost of this activity shall not exceed $ 1,000.00. <br />
