REGULAR MEETING JULY 1, 1986 PUBLIC HEARING AND FAVORABLE RECOMMENDATION E/W ALLEY NO. OF L.W.W. RUNNING W. FROM SHE Mr. Leszczynski advised that this was the d Board's Public Hearing on a proposed alley the lst east/west alley north of Lincolnway from Sheridan to Knoblock for a distance of in Post Place Addition to the City of South County, Indiana. - ALLEY VACATION: 1ST ate set for the vacation described as West running West 299 feet + all being Bend, St. Joseph It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by Mr. Steve Becsei, 1615 North Sheridan Street and Mr. Thomas A. Osborn, 1616 Knoblock Street, South Bend, Indiana. It was further noted that pursuant to South Bend Municipal Code Section 18-53.8, owners whose property abut the proposed alley to be vacated were notified of the Board's Public Hearing date. Mr. Thomas A. Osborn, 1616 Knoblock, South Bend, Indiana, Petitioner, was present and addressed the Board. Mr. Osborn stated that he is in favor of the alley being vacated as it currently is being used like a street. The closing of the alley would assure the safety of the residents and children in the neighborhood. Mr. Steve Becsei, 1615 North Sheridan Street, South Bend, Indiana, Petitioner, was also present and advised the Board that the alley is being used to dump garbage and trash and he is also in favor of the alley being closed to alleviate this problem. Mr. Osborn stated that the only other abutting property owner lives in Illinois but has advised him, in writing, that he is in favor of the vacation. There being no one else present wishing to speak either for or against the proposed alley vacation, and no written objections having been filed with the Board, upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard and carried, the Public Hearing on this matter was closed. Mr. Leszczynski advised that favorable comments have been received from the Engineering Department, Area Plan Commission and the Community Development Department concerning this proposed alley vacation. Mr. Vance suggested to Mr. Osborn that he provide to the Board, for its file, the letter from the other abutting property owner stating that he is in favor of the vacation. Mr. Osborn stated that he submitted that letter to the City Clerk's Office when he filed the petition to vacate. The Clerk of the Board was therefore, requested to secure a copy of that letter for the Board's files. Therefore, upon a motion made by Mr. Vance, seconded by Ms. Barnard and carried, the Clerk was instructed to forward to the Common Council a favorable recommendation on the above referred to alley vacation subject to any and all utility easements. APPROVE COMMUNITY DEVELOPMENT CONTRACT AND ADDENDUM The following Community Development Contract and Addendum were presented to the Board for approval: LINCOLNWAY WEST BUSINESS ASSOCIATION LINCOLNWAY WEST MARKET STUDY ACTIVITY The targeted goal for this activity is to conduct a market study of the Lincolnway West commercial strip. The total cost of this activity shall not exceed $ 1,000.00.
