A; � <br />REGULAR MEETING <br />JUNE 17, 1986 <br />interested individuals and present a recommendation to the Common <br />Council who has the final authority for either the approval or <br />denial of the Vacation Petition. <br />Mr. Miller inquired if all the residents of the area affected <br />that have fences on the public right-of-way will have to appear <br />before the BZA as well. Ms. Barnard stated that her office will <br />follow-up on that matter. <br />Mrs. Viro Thompson, 1108 North St. Peter Street, South Bend, <br />Indiana, one of the Petitioners, stated that she has a fence <br />around her house and around one -quarter of a lot that she owns. <br />Mr. Miller advised the Board that Ms. Thompson's fence is on the <br />public right-of-way. Mr. Leszczynski and Ms. Barnard advised Ms. <br />Thompson that they will stay in touch with her regarding this <br />matter. <br />APPROVE AND ADOPT RESOLUTION NO. 13-1986 - JOINT RESOLUTION OF <br />THE BOARD OF PUBLIC WORKS AND THE BOARD OF PARK COMMISSIONERS_ OF <br />THE PARK DISTRICT OF THE CITY OF SOUTH BEND <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Barnard <br />and carried, the following Board Resolution No. 13-1986, being a <br />Joint Resolution of the Board of Public Works and the Board of <br />Park Commissioners was approved and adopted: <br />RESOLUTION NO. 13-1986 <br />A JOINT RESOLUTION OF THE <br />BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND <br />AND THE BOARD OF PARK COMMISSIONERS OF THE <br />PARK DISTRICT OF THE CITY OF SOUTH BEND <br />WHEREAS, the Board of Public Works of the City of South <br />Bend (Public Works) owns in fee simple certain parcels of <br />land within the City of South Bend, more fully described in <br />Attachments A, B, and C, attached to and made a part of this <br />resolution (Property); and <br />WHEREAS, the Board of Park Commissioners of the Park <br />District of the City of South Bend (Park Board) on November <br />29, 1985, adopted a resolution entitled "A Resolution of the <br />Board of Park Commissioners of the Park District of the City <br />of South Bend Declaring Its Intent to Acquire By Lease/ <br />Purchase a Stadium Facility, to Acquire Other Property and to <br />Construct Improvements Thereon", in which it declared its <br />determination to acquire certain improvements and works of <br />construction within the Park District of the City of South <br />Bend (Park District), for the purpose of establishing a new <br />park to be owned and operated by the Park District, to add the <br />park to the plan of the Park District, and to name the park <br />the Stanley Coveleski Regional Stadium Park (Park); and <br />WHEREAS, by a resolution adopted December 9, 1985, the <br />Park Board ratified and confirmed in all respects the Park <br />Resolution. <br />WHEREAS, the property is within the area within which the <br />Park Board will develop the Park; <br />NOW, THEREFORE, BE IT RESOLVED BY the Board of Public Works <br />of the City of South Bend and the Board of Park Commissioners <br />of the Park District of the City of South Bend, as follows: <br />1. The paragraphs above are incorporated into and made <br />a part of this resolution. <br />
