E <br />REGULAR MEETING <br />FEBRUARY 18, 1986 <br />Ms. Barnard inquired of Mr. Buchanan what he was going to use the <br />property for which he would acquire through this alley vacation. <br />He stated that his intent was.to be able to keep the property <br />clean of debris. Ms. Barnard stated that when she visited the <br />site of the proposed alley to be vacated she noticed that some <br />people have already begun to block the alley. <br />Mr. Leszczynski advised that with the closing of this alley a <br />T-intersection would be created. Typically, in this type of <br />situation, the Petitioner is asked to dedicate additional <br />right-of-way to the City to assure safe turning movements for <br />vehicles.. Mr. Leszczynski informed Mr. Buchanan that strips of <br />right-of-way off Lots 6 and 10 would be required. Mr. Buchanan <br />indicated that he understood this request and had no problems in <br />complying. <br />Therefore, upon a motion made by Mr. Leszczynski, seconded by Ms. <br />Barnard and carried, the Clerk was instructed to forward to the <br />Common Council a favorable recommendation on the above referred <br />to alley vacation subject to the dedication of additional <br />right-of-way from Lots No. 6 and 10 and subject to any and all <br />utility easements. <br />RESCISSION OF IMPROVEMENT RESOLUTION NO. 3518-1983 FILING OF <br />PRELIMINARYASSESSMENT ROLL, ADOPTION OF IMPROVEMENT RESOLUTION <br />NO. 3522-1986 AND SETTING OF PUBLIC HEARING DATE - RIVERSIDE <br />DRIVE/RIVERSIDE PLACE SANITARY SEWER PROJECT <br />Mr. Leszczynski stated that plans have been completed by the <br />Consultant in regards to the above referred to project and <br />therefore, the Engineering Department has prepared Improvement <br />Resolution No. 3522-1986, the Preliminary Assessment Roll and <br />plans and engineer's estimate for the above referred to project. <br />Mr. Leszczynski further stated that Improvement Resolution No. <br />3518-1983 together with estimate, plans and assessment roll that <br />was adopted by the Board on February 14, 1983, needs to be <br />rescinded at this time. <br />Mr. Leszczynski additionally advised that the above referred to <br />project is proceeding under the procedures outlined in the <br />Barrett Law statute regarding this type of improvement. As <br />required, a Public Hearing date of March 11, 1986, is being <br />recommended in order for the Board to hear all affected property <br />owners and persons interested in this improvement. <br />In response to a question by Ms. Barnard, the Clerk advised that <br />all property owners affected by this improvement will be notified <br />of the Board's Public Hearing date as well as their individual <br />assessments. <br />In response to Mr. Vance's statement that this improvement is <br />proceeding in response to an Order from the St. Joseph County <br />Health Department filed with the Board on February 14, 1983, Mr. <br />Leszczynski stated that at that time, residents filed a lawsuit <br />against the City. However, at this time, the lawsuit has been <br />dismissed and the City was instructed to proceed. <br />Therefore, upon a motion made by Mr. Vance, seconded by Ms. <br />Barnard and carried, Improvement Resolution No. 3518-1983 was <br />rescinded, a new Preliminary Assessment Roll was accepted for <br />filing, the following Improvement Resolution No. 3522-1986 was <br />adopted and a Public Hearing date set for March 11, 1986: <br />DEPARTMENT OF PUBLIC WORKS <br />CITY OF SOUTH BEND, INDIANA <br />IMPROVEMENT RESOLUTION NO. 3522, 1986 <br />South Bend, Indiana <br />
