19 <br />REGULAR MEETING <br />JULY 7, 1987 <br />The regular meeting of the Board of Public Works was convened at <br />9:31 a.m. on Tuesday, July 7, 1987, by Board member Michael L. <br />Vance with Mr. Vance and Mrs. Patricia E. DeClercq present. <br />Board President John E. Leszczynski was not in attendance. Also <br />present was Chief Deputy City Attorney Thomas Bodnar. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Vance, seconded by Mrs. DeClercq and <br />carried, the approval of nine (9) Sidewalk Sale Permit <br />applications and four (4) Open Air Stand license applications was <br />added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Vance, and <br />carried, the minutes of the June 30, 1987, regular meeting of the <br />Board were approved. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - STREET VACATION: <br />40' RIGHT-OF-WAY OF LATHROP STREET FROM N.W. CORNER OF SECTION <br />TO 450_' W. OF W. RIGHT-OF-WAY LINE OF FOUNDATION DRIVE <br />Mr. Vance advised that this was the date set for the Board's <br />Public Hearing on a proposed street vacation described as <br />follows: <br />The 40 foot right-of-way of Lathrop Street from the north- <br />east corner of Section 33, Township 38 North, Range 2 <br />East, East to 450 feet West of the West right-of-way <br />line of Foundation Drive, a distance of approximately <br />2,000 feet. <br />It was noted that the Public Hearing was being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. John C. Schalliol, <br />St. Joseph County Airport Authority, 4477 Terminal Drive, South <br />Bend, Indiana. It was further noted that pursuant to South Bend <br />Municipal Code Section 18-53.8, owners whose property abut the <br />proposed street to be vacated were notified of the Board's Public <br />Hearing date. <br />Mr. John Schalliol, St. Joseph County Airport Authority, <br />Petitioner, addressed the Board and requested favorable approval <br />of the Petition to vacate. Mr. Schalliol stated that the above <br />referred to property will become the main entrance to the general <br />aviation area of the airport. He further advised that the <br />Airport Authority owns all the property on both sides of the <br />street except for a small portion that is owned by St. Joseph <br />County and used as a landfill and it is the long-range plan of <br />the airport authority to acquire this property currently owned by <br />St. Joseph County. <br />It was noted that the Petition to Vacate indicated that the <br />purpose of the vacation of the portion of Lathrop Drive as <br />described above is to allow for the continued orderly development <br />of the Michiana Regional Airport in accordance with the 1971 <br />master Plan Study and the current Airport Layout Plan. <br />There being no one else present wishing to speak either for or <br />against the proposed vacation, and no written objections having <br />been filed with the Board, upon a motion made by Mr. Vance, <br />seconded by Mrs. DeClercq and carried, the Public Hearing on this <br />matter was closed. <br />Mr. Vance advised that favorable recommendations have been <br />received from the Engineering Department, Area Plan Commission <br />and the Community Development Department concerning this proposed <br />vacation. <br />
