LEASE <br />THIS LEASE (the or this "Lease ") is made by and between the City of South Bend, Indiana, Department of <br />Redevelopment, acting by and through the South Bend Redevelopment Commission, (the "Landlord ") and SPARK <br />DESIGN STUDIO, LLC, an Indiana limited liability company (the "Tenant ") as of the date of last execution hereof <br />by Landlord or Tenant (the "Effective Date "). <br />WITNESSETH: <br />ARTICLE I. <br />BASIC LEASE PROVISIONS <br />1.1. Basic Lease Provisions. The following basic provisions of this Lease (the "Basic Lease <br />Provisions ") constitute an integral part of this Lease and are set forth in this Section 1.1 for the convenience of the <br />parties. Each reference in this Lease to a Basic Lease Provision shall be construed to incorporate all of the terms <br />provided for under such provisions. <br />(a) Leased Premises: <br />Defined in Section 2.1 hereof, consisting of <br />approximately 1,423 square feet of "Floor Area." <br />(b) Term: <br />Initial Term of Three (3) Lease Years, with two (2) <br />options of Three (3) years each to extend the Initial <br />Term, all as provided for in Sections 3.1 and 3_2 hereof <br />(c) Tenant's Use: <br />Retail Sale of Stationary, Gifts and Related Items <br />(d) Tenant's Trade Name: <br />Spark Fine Stationary (or such other trade name taken <br />by the Tenant) <br />(e) Landlord's Address: <br />1200 County -City Building <br />227 West Jefferson Boulevard <br />South Bend, Indiana 46601 <br />(f) Tenant's Address: <br />P.O. Helmuth <br />Facsimile Number: <br />(g) Lease Year: <br />A "Lease Year" shall mean each period of twelve (12) <br />consecutive full months, beginning on the <br />Commencement Date as defined in Section 3.1 (such <br />that if the Commencement Date is not the first day of a <br />calendar month, then the first Lease Year shall begin on <br />the first day of the first calendar month following the <br />Commencement Date, and any partial month in which <br />the Commencement Date occurs will be included within <br />the first Lease Year). <br />(h) Security Deposit: An amount equal to the first month's Modified Gross <br />Rent as security deposit shall be due upon signing of <br />lease. <br />(i) The Building: Michigan Street Shops, commonly referred to as 117 — <br />131 S. Michigan St, South Bend, Indiana, as more <br />particularly described in Exhibit A, and depicted in <br />
