REGULAR MEETING <br />JUNE 16, 1987 <br />um <br />1 <br />1 <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Vance and carried, the Public <br />Hearing on this matter was closed. <br />Mr. Leszczynski advised that favorable comments have been <br />received from the Engineering Department, Area Plan Commission <br />and the Department of Economic Development concerning this <br />proposed alley vacation. <br />Mr. Vance stated that he would not have a problem with a <br />favorable recommendation being submitted to the Common Council <br />but questioned if said recommendation should contain language <br />providing for the concerns of Indiana and Michigan Electric <br />Company. <br />Mr. Leszczynski informed Mr. Vance that the ordinance which will <br />be submitted to the Common Council regarding this vacation <br />contains, in Section II, language which states that the City <br />reserves the rights and easements of all utilities to construct <br />and maintain any facilities, including, but not limited to, <br />electric, telephone, gas, water, sewer, surface water control <br />structures and ditches, within the vacated right-of-way unless <br />such rights are released by the individual utilities. Mr. <br />Leszczynski further informed Mr. Vance that any structures built <br />on the vacated alley would be removed when access was required. <br />Therefore, upon a motion made by Mr. Vance, seconded by Mr. <br />Leszczynski and carried, the Clerk was instructed to forward to <br />the Common Council a favorable recommendation on the above <br />referred to alley vacation subject to any and all utility <br />easements. <br />ACCEPT AND APPROVE DEDICATION OF RIGHT-OF-WAY - VIRIDIAN DRIVE <br />Mr. Leszczynski advised that the Industrial Foundation, Inc. has <br />submitted a Dedication of Right -of -Way which dedicates and <br />conveys to the City a parcel of real estate located on the South <br />edge of Boland Drive and running perpendicular to Boland Drive <br />and located at the Northwest Corner of the Southeast Quarter of <br />Section 28, Township 38 North, Range 2 East, St. Joseph County <br />and commonly known as Viridian Drive. Upon a motion made by Mr. <br />Leszczynski, seconded by Mr. Vance and carried, the Dedication as <br />submitted was accepted and approved. <br />ADOPTION OF RESOLUTION <br />EQUIPMENT (STREET DEPA <br />14-1987 - DISPOSAL OF OBSOLETE <br />Upon a motion made by Mr. Vance, seconded by Mr. Leszczynski and <br />carried, the following Resolution No. 14-1987 was adopted: <br />RESOLUTION NO. 14-1987 <br />WHEREAS, it has been determined by the Board of Public <br />Works that the following Street Department equipment is no longer <br />suitable for the purpose for which it was intended and no longer <br />needed by the City of South Bend: <br />1.
