Box 259, Leesburg, N.J. has advised that they choose not to <br />submit a bid on street materials at this time. <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Vance and <br />carried, the above bids were referred to the Street Department <br />for review and recommendation. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION <br />OF ADDITIONAL RIGHT-OF-WAY - ALLEY VACATION: <br />SUBJECT TO DEDICATION <br />1ST N/S ALLEY E. OF <br />MICHIGAN STREET RUNNING SO. FROM WOODSIDE FOR A DISTANCE OF 134 <br />FEET <br />Mr. Vance advised that this was the date set for the Board's <br />Public Hearing on a proposed alley vacation described as follows: <br />The 1st north/south alley east of Michigan Street running <br />South from Woodside for a distance of 134 feet all being in <br />Krou & Whitmore Add to the City of South Bend. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Robert Cira, Cira's <br />SuperMarket, 2904 South Michigan, South Bend, Indiana. It was <br />further noted that Mr. Joseph A. and Rose T. Cira and Robert J. <br />and Mary Ann Cira are owners of all property abutting the <br />proposed alley to be vacated and were notified of the Board's <br />Public Hearing date. <br />Mr. Joseph Cira of Cira's Supermarket, Petitioner, was present at <br />the meeting and stated that he had no comments regarding the <br />vacation. It was noted that the ordinance submitted with the <br />Vacation Petition stated that the purpose of the vacation is to <br />allow construction of a parking lot in conjunction with a new <br />supermarket. . <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Vance, seconded by Mrs. DeClercq and carried, the Public Hearing <br />on this matter was closed. <br />Mrs. DeClercq advised that she has reviewed the recommendations <br />received from the various departments and bureaus that have <br />reviewed this request and based on that information would <br />recommend that the Clerk forward to the Common Council a <br />favorable recommendation on the above referred to alley vacation <br />subject to any and all utility easements. Mr. Vance seconded the <br />motion and it carried. Mr. Vance stated, however, that he would <br />1 <br />
