REGULAR MEETING <br />MARCH 10, 1987 <br />survey dated April 22, 1983); thence North <br />56 40'30" East parallel to and 25 feet South- <br />easterly (measured at right angles to the centerline <br />of ICC Track No. 77) from the centerline of the New <br />Jersey, Indiana and Illinois Railroad Company's <br />"Studebaker Spur" and also known as ICC Track No. <br />77, 126.44 feet to the West line of Olive Street; <br />thence South 00 00'30" West along the West line <br />of Olive Street, 69.23 feet to the point of <br />beginning, containing 0.084 acres. <br />BE IT FURTHER RESOLVED for each parcel of real estate <br />the Board of Public Works authorizes the Legal Department of <br />the City of South Bend to extend on behalf of the City of <br />South Bend an offer to the owners of said parcels of real <br />estate for the fair market value of the property and, if <br />the offer is now accepted within the time prescribed by <br />statute, the legal department is authorized and directed to <br />file a complaint, in the name of the City of South Bend; <br />Indiana, in .an appropriate court of St. Joseph County, Indiana, <br />in order that appraisers be appointed to establish the value of <br />said real estate, and all other necessary and proper actions be <br />taken to accomplish the taking by eminent domain pursuant to law. <br />Adopted at the Regular Meeting of the Board of Public Works <br />of the City of South Bend, Indiana, held on March 10, 1987, on <br />the 13th Floor of the County -City Building, 227 West Jefferson <br />Boulevard, South Bend, Indiana 46601. <br />BOARD OF PUBLIC WORKS OF THE CITY <br />OF SOUTH BEND, INDIANA <br />s/John E. Parmerlee, Clerk <br />APPROVE RELEASE AGREEMENT - F.I.R.E., INC. <br />Mr. Leszczynski advised that submitted to the Board for approval <br />at this time is a Release Agreement which releases the City from <br />a Lease which was entered into on July 23, 1979 with F.I.R.E., <br />Inc., a not -for -profit corporation, which leased to the City the <br />premises at 1322 Lincolnway East which was used by the Youth <br />Services Bureau as a residence. As the Youth Services Bureau is <br />no longer a part of the City of South Bend, the City should be <br />released from the Lease. Therefore, upon a motion made by Mrs. <br />DeClercq, seconded by Mr. Vance and carried, the Release <br />Agreement was approved and executed. <br />APPROVE CHANGE ORDER NO. 1 (FINAL) - STATE THEATER RE -ROOFING AND <br />MISCELLANEOUS REPAIRS PROJECT <br />Mr. Leszczynski advised that Slatile Roofing and Sheet Metal, <br />Inc. and Ken Herceg & Associates, Inc., Contract Engineers, have <br />submitted Change Order No. 1 (Final) indicating that the Contract <br />amount be increased by $7,649.50 for a new Contract sum including <br />this Change Order in the amount of $72,399.50. Mr. Leszczynski <br />stated that this Change Order reflects miscellaneous items that <br />were discovered once work commenced.
