REGULAR MEETING MARCH 10, 1987 survey dated April 22, 1983); thence North 56 40'30" East parallel to and 25 feet South- easterly (measured at right angles to the centerline of ICC Track No. 77) from the centerline of the New Jersey, Indiana and Illinois Railroad Company's "Studebaker Spur" and also known as ICC Track No. 77, 126.44 feet to the West line of Olive Street; thence South 00 00'30" West along the West line of Olive Street, 69.23 feet to the point of beginning, containing 0.084 acres. BE IT FURTHER RESOLVED for each parcel of real estate the Board of Public Works authorizes the Legal Department of the City of South Bend to extend on behalf of the City of South Bend an offer to the owners of said parcels of real estate for the fair market value of the property and, if the offer is now accepted within the time prescribed by statute, the legal department is authorized and directed to file a complaint, in the name of the City of South Bend; Indiana, in .an appropriate court of St. Joseph County, Indiana, in order that appraisers be appointed to establish the value of said real estate, and all other necessary and proper actions be taken to accomplish the taking by eminent domain pursuant to law. Adopted at the Regular Meeting of the Board of Public Works of the City of South Bend, Indiana, held on March 10, 1987, on the 13th Floor of the County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601. Parmerlee, Clerk APPROVE RELEASE AGREEMENT - F.I.R.E., INC. Mr. Leszczynski advised that submitted to the Board for approval at this time is a Release Agreement which releases the City from a Lease which was entered into on July 23, 1979 with F.I.R.E., Inc., a not -for -profit corporation, which leased to the City the premises at 1322 Lincolnway East which was used by the Youth Services Bureau as a residence. As the Youth Services Bureau is no longer a part of the City of South Bend, the City should be released from the Lease. Therefore, upon a motion made by Mrs. DeClercq, seconded by Mr. Vance and carried, the Release Agreement was approved and executed. APPROVE CHANGE ORDER NO. 1 (FINAL) - STATE THEATER RE -ROOFING AND MISCELLANEOUS REPAIRS PROJECT Mr. Leszczynski advised that Slatile Roofing and Sheet Metal, Inc. and Ken Herceg & Associates, Inc., Contract Engineers, have submitted Change Order No. 1 (Final) indicating that the Contract amount be increased by $7,649.50 for a new Contract sum including this Change Order in the amount of $72,399.50. Mr. Leszczynski stated that this Change Order reflects miscellaneous items that were discovered once work commenced. Upon a motion made by Mr. Vance, seconded by Mrs. DeClercq and carried, Change Order No. 1 (Final), as submitted, was approved.
