REGULAR MEETING NOVEMBER 7, 1988 The regular meeting of the Board 9:32 a.m. on Monday, November 7, Leszczynski with Mr. Leszczynski, Ms. Katherine Humphreys present. Attorney Marva Leonard -Dent. of Public Works was convened at 1988 by Board President -John E.. Mrs. Patricia E. DeClercq and Also present was Assistant City APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys and carried; the minutes of the regular meeting of, -the -Board of Public Works held on October 31, 1988 were approved. OPENING OF BIDS - INWOODS BLOCK RELANDSCAPING PROJECT' This was the date set for receiving and opening of sealed bids for the above referred to project. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri-County News which were found to be sufficient. The following bid was opened and publicly read: L.L. GEANS AND SONS, INC. 56535 Magnetic Drive Mishawaka, Indiana Bid was signed by Rocky R. Geans, President, Non -Collusion Affidavit was in order and a 5% Bid Bond was submitted. BID: - TOTAL BASE BID - $39,687.60 BASE BID PLUS ALTERNATE TOTAL - $50,681.00 Upon a motion made by Mr. Leszczynski, seconded by Ms. Humphreys and carried, the bid was referred to the Engineering Department for review and recommendation. PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATION: 1ST E/W ALLEY S. OF THE INTERSECTION OF STULL AND LAFAYETTE STREETS ON THE WEST SIDE OF LAFAYETTE RUNNING W. FROM LAFAYETTE A DISTANCE OF APPROX. 165--FT: Mr. Leszczynski advised -that -this was -..the - date -set -for -the - - Board's Public Hearing on a proposed alley_ vacation described as follows: The First East-West Alley South of the intersection of Stull and Lafayette Streets on the West side of Lafayette Street running West from Lafayette Street a distance of approximately 165 feet to the East side of the North and South alley and same alley being between Lots 21 and 26 and being 14 feet wide and running West from Lafayette Street 165 feet to the East side of the North and South alley all being in the Recorded Plat of Samuel C. Stull's Second Addition to the City of South Bend, Indiana. It was noted that this Public Hearing is being held in order for the Board to -submit a recommendation to the Common Council - concerning' -the -Vacation Petition -filed by -Mr. Melvin Reed, Melvin Reed Professional Corporation,--128 East South-Street,--South-,Bend, Indiana on behalf of Petitioners, W. H. Calvin Murdock, - President, Omega Properties, Inc., 1330 South Franklin Street and Irene Williams, 203 West Pendle Street, South Bend, Indiana.` It was further.noted.that pursuant to South Bend Municigal.Code Section 18-53.8, owners whose property abut the proposed alley to be vacated as well as those within fifty (50) feet of the alley to be vacated were notified of the Board's Public Hearing date. Mr. Melvin -Reed, Melvin -Reed -Professional Corporation, 128 East South Street; -South Bend, Indiana; -was present on behalf - of -=the Petitioners.- -.Mr. -Reed advised --that the -purpose .-of--the vacation -- is to allow Omega Properties, Inc. to build its corporate offices at the location indicated above which includes a portion of the above referred to alley.
