REGULAR MEETING <br />OCTOBER 17, 1988 <br />the City of South Bend, Indiana, <br />opening into the mezzanine level <br />Source Center; and <br />and interconnecting with and <br />of the Marriott Hotel in the 1st <br />WHEREAS, the South Bend Board of Public Works is the owner <br />and titleholder of record of Buildings 3, 4 and 5 of Century <br />Center, as depicted on Exhibit "I", attached hereto and <br />incorporated herein, and is the lessee of Buildings 1 and 2 <br />depicted on Exhibit "I"; and <br />WHEREAS, the South Bend Redevelopment Commission desires to <br />convey all of its right, title and interest in and to the Skywalk <br />to the South Bend Board of Public Works, and the South Bend Board <br />of Public Works desires to accept such conveyance; and <br />WHEREAS, IC36-1-11-8 provides that a governmental entity may <br />transfer or exchange property with another governmental entity <br />upon terms and conditions agreed upon by those entities by <br />adopting a substantially identical resolution, and that such <br />transfer may be made for any amount of real property, cash, or <br />other personal property as agreed upon by the entities. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend <br />Redevelopment Commission and the South Bend Board of Public <br />Works, as follows: <br />1. For good and valuable consideration given each to the <br />other, receipt of which is hereby acknowledged, the South Bend <br />Redevelopment Commission hereby conveys to the South Bend Board <br />of Public Works and the South Bend Board of Public Works hereby <br />accepts conveyance from the South Bend Redevelopment Commission <br />of the Skywalk, which is more particularly described as follows: <br />PARCEL I: A portion of a pedestrian walkway 22.00 feet in <br />width over and above that portion of St. Joseph Street <br />(US 33) adjoining Lot 3 of the River Bend Addition to <br />the City of South Bend, Indiana as recorded in the <br />Office of the Recorder of St. Joseph County, Indiana <br />in Plat Book 31, Page "R", more particularly described <br />as follows: <br />Beginning at a point on the East line of said Lot 3 <br />(West R/W line of St. Joseph St.) which is North <br />0°25'11" West, 21.82 feet from the Southeast corner of <br />said Lot 3; thence North 89°34'49" East, 85.00 feet to <br />the East R/W line of St. Joseph St.; thence North <br />0°25'11" West, 22.00 feet along said East R/W line; <br />thence South 89°34'49" West, 85.00 feet to the West <br />R/W line of St. Joseph St. (East line of Lot 3); <br />thence South 0°25111" East, 22.00 feet to the Point of <br />Beginning; the bottom plane of the vertical space con- <br />tained herein shall be elevation 720.33 feet (USGS Datum); <br />and the top plane of the vertical space herein shall be <br />elevation 746.50 feet; and <br />PARCEL II: A portion of a pedestrian walkway 22.00 feet <br />in width, from the east line of St. Joseph Street to the <br />entrance at the Century Center and being described from <br />Lot No. 3 of River Bend Addition to the City of South <br />Bend, Indiana, as recorded in the Office of the <br />Recorder of St. Joseph County, Indiana, in Plat Book <br />31, Page "R", more particularly described as follows: <br />Beginning at a point on the east line of said Lot No. 3 <br />(West Right of Way Line of St. Joseph Street) which is <br />North 00°25'11" West, 21.82 feet from the southeast <br />corner of said Lot No. 3; thence North 89°34'49" East, <br />85.00 feet to a point on the east line of St. Joseph <br />Street, said point being the Point of Beginning of <br />this Description; thence North 89°34149" East, 8.27 <br />feet; thence South 45°25'11" East, 66.66 feet; thence <br />
