REGULAR MEETING OCTOBER 17, 1988 ($3,667,825.00), respectively (hereinafter referred to collec- tively as the "Grants"), to construct certain improvements necessary for the operation of the City's Waste Water Treat- ment Plant (the "Plant"), a description of said required improvements being attached hereto and marked as Exhibit "A" (the "Improvements"); and WHEREAS, the Board of Public Works intends to recommend to the Common Council of the City of South Bend, Indiana, that it adopt a new rate ordinance applicable to the Plant and a bond ordinance ordering the issuance of Waste Water Treatment Plant revenue bonds (the "Revenue Bonds") in an amount sufficient to repay all amounts advanced for preliminary expenses under IC 36-9-23-20 and to pay the costs of acquiring and construct- ing that portion of the Improvements to the Plant not paid for with the proceeds of the Grants; and WHEREAS, the Board of Public Works has employed the consulting engineering firm of TenEch Engineering, Inc. for purposes of designing the required Improvements to the Plant and preparing plans, specifications and cost estimates of the Improvements; and WHEREAS, the plans, specifications and cost estimates have been completed and filed with the Board of Public Works, copies of which are attached hereto and marked as Exhibit "B"; and WHEREAS, the plans, specifications and cost estimates have been approved by the Indiana Department of Environmental Manage- ment (the "IDEM"), said approval constituting the approval of the EPA pursuant to the Grants, and the IDEM has issued a construction permit authorizing the construction of the Improvements by the Board of Public Works, WHEREAS, the Board of Public Works desires to approve the plans, specifications and cost estimates as filed and authorize the publication of notice of bids for the construction of the Improvements, with the award of said bids to be subject to the award of grants and issuance of the Revenue Bonds; and WHEREAS, certain preliminary expenses relating to the construction of the Improvements have been and will continue to be incurred by the Board of Public Works and advanced by the City before the issuance and delivery of the Revenue Bonds and the Board of Public Works desires that the City be reimbursed for said preliminary costs and further desires to establish its intent to be reimbursed from the proceeds of the Revenue Bonds; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS, AS FOLLOWS: 1. The Board of Public Works hereby approves the plans, specifications and cost estimates for the construction of the Improvements as filed with the Board of Public Works. 2. The Board of Public Works hereby authorizes the publication of notice of bids for the construction of the Improvements with the award of said bids to be subject to the award of grants and issuance of the Revenue Bonds. 3. The Board of Public Works hereby establishes its intent that the City be reimbursed for funds advanced to pay the preliminary costs incurred by the Board of Public Works relating to the Improvements from the proceeds of Revenue Bonds to be issued by the City. 4. This resolution shall be in full force and effect after its adoption by the Board of Public Works.
