REGULAR MEETING SEPTEMBER 26, 1988 Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the following Resolution No. 27-1988 was adopted: RESOLUTION NO. 27-1988 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA RECOGNIZING IT'S AUTHORITY OVER THE OPERATION OF THE CITY SEWAGE WORKS. WHEREAS, I.C. 36-9-23-3 provides that the construction, acquisition, improvement, operation and maintenance of sewage works shall be supervised and controlled by the municipal works board; and WHEREAS, the South Bend Board of Public Works (the "Board of Public Works") has historically exercised such authority, acting under the title of "Board of Wastewater Commissioners;" and WHEREAS, greater administrative efficiency and more strict statutory compliance can be achieved by eliminating the title "Board of Wastewater Commissioners" and thereby bringing the supervision and control of the municipal sewage works directly under the Board of Public Works. BE IT THEREFORE RESOLVED by the Board of Public Works of the City of South Bend, Indiana that: Section I. The construction, acquisition, improvement, operation and maintenance of the municipal sewage works shall hereafter be supervised and controlled by the Board of Public Works. Section II. The Board of Public Works hereby ratifies and assumes responsibility for all contracts entered into by the Board of Public Works acting under the title of "Board of Wastewater Commissioners" prior to this date. Parmerlee, Clerk Board of Public Works APPROVE REQUEST TO ADVERTISE FOR _RECEIPT OF BIDS - INWOODS BLOCK RELANDSCAPING PROJECT In a letter to the Board, Mr. Michael P. Meeks, Director, Division of Engineering, requested that the Board advertise for the receipt of bids for Inwoods Block Relandscaping. He advised that this project entails removal and lowering of existing landscaping, repairing planters and replanting trees. Upon a motion made by Mrs. DeClercq, seconded by Mr. Leszczynski and carried, the above request was approved. Ms. Katherine Humphreys, Director, Administration and Finance, requested that the Board advertise for the receipt of Proposals for property and casualty insurance coverage for the City of South Bend. She informed the Board that this re uest is in 9. accordance with the practice of accepting Proposals every three (3) years. Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the request was approved.
