24 0, <br />REGULAR MEETING AUGUST 15, 1988 <br />Mr. James Cronk, owner of the buildings, was present and stated <br />that the City refused to issue permits to him to remodel. Mr. <br />Leszczynski advised Mr. Cronk that the issue before the Board <br />today was the opening of bids for demolition and remodeling, not <br />what happened with the Department of Code Enforcement. The City <br />was given permission by a Court of Law to demolish the buildings. <br />Mr. Cronk felt he should be given a chance to be heard. Mrs. <br />DeClercq stated that the Department of Code Enforcement requested <br />the Board of Public Works to advertise for bids for this project. <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the bids received were referred to the Department of <br />Code Enforcement and the Engineering Department for review and <br />recommendation. <br />AVENUE <br />Mr. Leszczynski <br />Public Hearing <br />advised that this was the date set for the Board's <br />on a proposed alley vacation described as follows: <br />The North one-half of the First North/South alley East <br />of Bendix Drive, running South from Bonds Avenue for a <br />distance of approximately 114.93 feet <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. John B. Ford, <br />Attorney at Law, 1800 Valley American Bank Building, P.O. Box <br />4577, South Bend, Indiana, on behalf of the Saint Joseph's Medical <br />Center, Inc., 811 East Madison, South Bend, Indiana. It was <br />further noted that pursuant to South Bend Municipal Code Section <br />18-53.8, owners of property within fifty (50) feet of the proposed <br />alley to be vacated were notified of the Board's Public Hearing <br />date. <br />Mr. John B. Ford, Attorney at Law, 1800 Valley American Bank <br />Building, South Bend, Indiana, was present on behalf of the <br />Petitioner, Saint Joseph's Medical Center, Inc., and addressed the <br />Board. Mr. Ford requested the Board's favorable consideration of <br />this Vacation Petition and stated that the purpose of the vacation <br />is to unify property owned by Saint Joseph's Medical Center, Inc., <br />and facilitate the use of Lot 28, by the Center. He presented the <br />Board with a copy of the site plan and stated that St. Joseph's <br />Medical Center ownes property on both sides of the alley. The lot <br />immediately to the east of the alley is unusable without this <br />vacation. The alley will be improved and left open for local <br />traffic. Ms. Humphreys inquired who would be using the alley. <br />Mr. Ford advised her that the people who live in that block would <br />use it. The alley will be paved and there will be room for turn <br />around. Mr. Ted Kawka, 3029 Bonds Avenue was present. He wanted <br />to know why the Hospital was only going to pave the alley half way <br />and why the City should provide access to their property. Mr. <br />Ford advised him that they will only own half the alley, and <br />therefore, could not pave the City's portion. Mr. Kawka also <br />inquired why the hospital is not maintaining their property now. <br />He stated that he has to call Code Enforcement to get the weeds <br />cut. Mr. William Hambling, St. Joseph's Medical Center, was <br />present and advised Mr. Kawka he would get the weeds cut right <br />away. He also offered to meet with Mr. Kawka this afternoon to <br />take care of any problems. Mr. Leszczynski stated that the <br />hospital would take care of and improve the alley, if vacated, <br />which seemed to be the concerns of Mr. Kawka. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mrs. DeClercq and carried, the Public <br />Hearing on this matter was closed. <br />1 <br />1 <br />1 <br />
