FWS <br />REGULAR MEETING <br />JUNE 6, 1988 <br />The regular meeting of the Board of Public Works was convened at <br />9:38 a.m. on Monday, June 6, 1988, by President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq <br />and Ms. Katherine Humphreys present. Also present was Board <br />Attorney Marva J. Leonard -Dent. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, Ethnic Festival Booth applications were added to the <br />agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the May 31, 1988, regular meeting of <br />the Board were approved. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATION: 1ST <br />E/W ALLEY NO. OF NORTHSIDE BLVD. RUNNING W. FROM OAKLAND FOR A <br />DISTANCE OF APPROX. 120 FT. TO 1ST INTERSECTING N/S ALLEY <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />follows: <br />The First East/West alley North of Northside Blvd. <br />running West from Oakland Street for a distance of <br />approximately 120 feet to the First intersecting <br />North/South alley, all located in Oakland Park <br />Addition to the City of South Bend. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Karen and John <br />Mitchell, 1237 Oakland Street, South Bend, Indiana and Mr. Chuck <br />Stultz, Executive Officer, Board of Realtors, 1357 Northside <br />Boulevard, South Bend, Indiana. It was further noted that <br />pursuant to South Bend Municipal Code Section 18-53.8, owners <br />whose property abut the proposed alley to be vacated as well as <br />those within fifty feet ( 50' ) of the alley to be vacated were <br />notified of the Board's Public Hearing date. <br />Mr. John Mitchell, Petitioner, was present and advised that the <br />proposed alley to be vacated is rarely used and that he currently <br />keeps the grass cut thereby making the alley accessible. He <br />further stated that when the alley is used, people speed through <br />it and litter it with trash. Mr. Mitchell stated that there is <br />adequate access to surrounding facilities without the use of this <br />alley. Therefore, for the safety of the children in the <br />neighborhood and to eliminate this hazard for the community in <br />general it is being requested that this alley be vacated. <br />There being no one else present wishing to -speak either for or <br />against this proposed alley vacation, upon a motion made by Mr. <br />Leszczynski, seconded by Ms. Humphreys and carried, the Public <br />Hearing was closed. <br />Mr. Leszczynski advised that favorable comments have been <br />received from the Engineering Department, Area Plan Commission <br />and Department of Economic Development concerning this proposed <br />alley vacation. <br />Mr. Mitchell was advised that the Board is in receipt of a letter <br />from Mr. Charles R. Stultz, Executive Officer, Board of Realtors, <br />1357 Northside Boulevard, South Bend, Indiana, Co -Petitioner on <br />the Vacation Petition, advising that he would like to withdraw <br />his name from the Petition due to the fact that he will have to <br />gain authorization on behalf of the Board of Realtors prior to <br />[i <br />Fj <br />I <br />
