REGULAR MEETING MAY 2, 1988 <br />ru <br />1 <br />The regular meeting of the Board of Public Works was convened at <br />9:35 a.m. on Monday, May 2, 1988, by Board President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and <br />Ms. Katherine Humphreys present. Also present was Board Attorney <br />Marva J. Leonard -Dent. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the April 25, 1988, regular meeting <br />of the Board were approved. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACAT <br />N/S ALLEY W. OF WILLIA <br />Mr. Leszczynski advise <br />Board's Public Hearing <br />follows: <br />T <br />that this was the date set for the <br />on a proposed alley vacation described as <br />The first north/south alley West of William Street, <br />extending North from the North line of Western Avenue <br />to the South line of the first intersecting East/West <br />alley north of Western Avenue, being in William S. Vail's <br />Addition to the Town (now City) of South Bend, St. Joseph <br />County, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Attorney C. Brian <br />Sauers, Barnes and Thornburg, 600 lst Source Center, 100 North <br />Michigan Street, South Bend, Indiana, on behalf of his client GMS <br />Realty, Inc., Mr. William C. Gates, President, 401 South <br />Lafayette Boulevard, South Bend, Indiana. It was further noted <br />that pursuant to South Bend Municipal Code Section 18-53.8, <br />owners whose property abut the proposed alley to be vacated as <br />well as those within three hundred (300) feet of the alley to be <br />vacated were notified of the Board's Public Hearing date. <br />Attorney C. Brian Sauers, Barnes and Thornburg, 600 lst Source <br />Center, 100 North Michigan Street, South Bend, Indiana, was <br />present on behalf of the Petitioner, GMS Realty, Inc., 401 South <br />Lafayette Boulevard, South Bend, Indiana. Mr. Sauers utilized a <br />diagram of the alley to be vacated to illustrate the property <br />owned by Gates and their purpose for the vacation. He stated <br />that Gates is trying to develop a building it owns and to develop <br />an area into a used car dealership. <br />The ordinance submitted with the Petition indicates that the <br />purpose of the vacation is to permit renovation and expansion of <br />automobile dealership and repair facility and adjoining storage <br />area. <br />Mr. K. C. Pocius, 312 South Taylor, South Bend, Indiana, <br />addressed the Board and stated that he has concerns that if the <br />alley is vacated it will create a T-intersection. He inquired <br />hove; the City will be able to provide basic services such as fire, <br />police and trash pick-up through the alley. Mr. Leszczynski <br />advised Mr. Pocius that those services will be provided as they <br />currently are as the vacation of the alley will create a <br />T-intersection alley and not a deadend alley. Mr. Pocius then <br />inquired whether the Petitioner would be granting an easement to <br />the City for a turnaround at the T-intersection. Mr. Sauers <br />advised that this concern has been addressed and discussed with <br />the Engineering Department and two easements will be granted one <br />being six (6) feet by twenty-seven (27) feet and the other being <br />six (6) feet by six (6) feet by eight (8) feet thus allowing the <br />corners to be enlarged for an adequate turning radius. <br />
