z <br />REGULAR MEETING <br />lu/: Zm`i�l[�: <br />the request submitted to the Board on February 8, 1988 by Mr. <br />Lloyd Taylor. Additionally, the new installation of a <br />handicapped parking space at 515 South Jackson is in response to <br />the request submitted to the Board on February 1, 1988 by Mr. <br />William F. Hehlinski. <br />In response to questions from the news media regarding the <br />removal of no parking and revision to open parking on the south <br />side of Wall Street from Greenlawn to Ironwood, Mrs. DeClercq, <br />Director, Department of Code Enforcement, advised that this <br />matter was discussed with students of Adams High School and <br />residents of the area and the City and the Park Department have <br />agreed to remove the no parking on this side of the street. She <br />stated that the no parking status will resume when school is out <br />for the summer. The no parking will resume in the summer when <br />there is heavy pedestrian traffic around Potawatomi Park as <br />safety is a prime concern of the City. <br />APPROVE CLAIMS <br />Mr. Juan Manigault, Executive Director, St. Joseph County Job <br />Training Program submitted a list containing one hundred <br />twenty-one (121) claims and recommended approval. Additionally, <br />Chief Deputy Controller John D. Leisenring, submitted Claim <br />Docket No. 5266 through Claim Docket No. 5479 and recommended <br />approval. Upon a motion made by Mr. Leszczynski, seconded by <br />Mrs. DeClercq and carried, the claims were approved and the <br />reports as submitted were filed. <br />PRIVILEGE OF THE FLOOR: <br />;STIONS AND 1 <br />POLICY FOR AWARD OF BIDS FOR <br />ABANDONED VEHICLES <br />Mrs. Charles Teske, 54830 Pear Road, South Bend, Indiana, advised <br />the Board that a few years ago when South Bend Auto Parts held <br />the City's Contract for the towing and storage of abandoned <br />vehicles and she submitted bids, the vehicles were not in the <br />same condition on the day they were to be picked -up as they were <br />when they were viewed prior to bidding. She stated that when she <br />went to pick-up the vehicle she was awarded it was damaged. At <br />that time she was told that if the vehicle was not in the same <br />condition as it was when it was originally viewed prior to <br />bidding that she didn't have to accept the vehicle and that it <br />would be sold to the next highest bidder. She inquired if the <br />same policy is still in effect as a Mr. William Milcherska <br />recently bid on some vehicles which he did not take. As a <br />result, the vehicles were offered for sale a second time, Mr. <br />Milcherska re -bid and was awarded the vehicles for less than the <br />amount he bid originally. Mrs. Teske wanted to know if someone <br />does not take the vehicles when they bid shouldn't the vehicle go <br />to the next highest bidder as was the policy previously. In this <br />particular instance, she stated that she was the next highest <br />bidder and she would have gotten the car. <br />CERNS <br />Board Attorney Thomas Bodnar stated that the City's remedy in <br />this type of situation could be to sue the bidder for breach of <br />contract. <br />Mrs. DeClercq stated that she does not know the details of the <br />situation Mrs. Teske described above involving Mr. Milcherska but <br />would look into the matter. <br />Mrs. Cindy Stremme, 25267 State Road 2, South Bend, Indiana, <br />Bidder, stated that by allowing someone to re -bid it is not fair <br />to the other bidders who bid with the intention of purchasing the <br />vehicles they are awarded. She suggested that the remedy would <br />be to not allow someone to bid again once they have defaulted on <br />a bid. <br />
