354 <br />REGULAR MEETING <br />NOVEMBER 27, 1989 <br />- Engineered Metal Improvement <br />2026 South Main Street <br />South Bend, Indiana <br />- Steel Warehouse Inc. <br />2722 West Tucker Drive <br />South Bend, Indiana <br />Mr. Leszczynski noted that these Permits are in accordance with <br />ordinance requirements. Therefore, Mrs. DeClercq made a motion <br />that the Permits as submitted be approved. Ms. Humphreys <br />seconded the motion which carried. <br />UEST OF CITY AWNING TO INSTALL <br />CK-LIT CANOPY AT 1511 SOUTH <br />MAIN STREET (BLUE JEANS FACTORY OUTLET) - REFERRED <br />In a letter to the Board, Mr. Bob Hinsch, Sales Representative, <br />City Awning of South Bend, 1835 South Franklin Street, South <br />Bend, Indiana, requested permission to install a back -lit canopy <br />at Blue Jeans Factory Outlet located at 1511 South Main Street, <br />South Bend, Indiana. Mr. Hinsch submitted with the request a <br />drawing for the frame as well as structure details. He noted <br />that the canopy will project two (2) feet out from the building <br />and will be eight feet four inches (81411) above the sidewalk. <br />Upon a motion made by Mr. Leszczynski, seconded by Ms. Humphreys <br />and carried, the above request was referred to the appropriate <br />City departments and bureaus for review and recommendation. <br />APPROVE REQUEST OF DEPARTMENT OF REDEVELOPMENT FOR TWO (2) <br />EASEMENTS AND APPROVE WALKWAY CONSTRUCTION, EASEMENT AND <br />OPERATING AGREEMENT <br />Mr. Leszczynski advised that the Board is in receipt of a letter <br />from Mr. Jon R. Hunt, Executive Director, Department of Economic <br />Development, advising that the Department of Redevelopment <br />requests the approval and the granting of air rights Easements to <br />the South Bend Redevelopment Authority in order to permit the <br />construction of two (2) suspended walkways over and above the <br />public right-of-way. The walkways will connect the St. <br />Joseph/Wayne Street Parking Garage with those buildings commonly <br />known as the Penny's Building and the IBM Building and will be <br />suspended over public alleyways. Mr. Hunt's letter noted the <br />dimensions of the proposed walkways and also indicated that the <br />legal descriptions as required for the Easements will be <br />forwarded to the Board when they become available. <br />Ms. Ann Kolata, Deputy Executive Director, Department of Economic <br />Development, was present and advised the Board that the Walkway <br />Construction, Easement and Operating Agreement provides for the <br />attachment of the walkway to the above referred to IBM Building <br />and also provides for the necessary Easements relating to the <br />placement of the walkways. Ms. Kolata briefly explained that the <br />Agreement indicates who is responsible for certain matters such <br />as operation and maintenance of the walkway. <br />Board Attorney Jenny Pitts Manier noted that two (2) separate <br />items are before the Board for consideration and therefore each <br />matter must be acted upon separately. <br />Therefore, Mrs. DeClercq made a motion that the request for two <br />(2) Easements be approved subject to the receipt of the required <br />legal descriptions. Ms. Humphreys seconded the motion which <br />carried. Additionally, Ms. Humphreys made a motion that the <br />Walkway Construction, Easement and Operating Agreement, between <br />the City of South Bend, the South Bend Redevelopment Commission, <br />the South Bend Redevelopment Authority and Combined Capitol <br />Associates VII, d/b/a Century Plaza Office Building with offices <br />11 <br />
