<br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys
<br />and carried, the Official Action forms as submitted by the
<br />Indiana Department of Highways concerning the above referred to
<br />controls to be established were approved and executed.
<br />APPROVE INDEMNIFICATION AND HOLD HARMLESS AGREEMENT - CROWE,
<br />CHIZEK AND COMPANY AND THE HOLLADAY CORPORATION (ETHNIC FESTIVAL
<br />PARADE)
<br />Submitted to the Board for approval was an Indemnification and
<br />Hold Harmless Agreement between the City of South Bend, The
<br />Holladay Corporation and Crowe, Chizek and Company. The
<br />Agreement indicated that Holladay Corporation and Crowe, Chizek &
<br />Company are owners of real estate at 100 East Wayne Street and at
<br />330 West Jefferson Boulevard respectively and that the City
<br />wishes to utilize their property for disassembly of the Ethnic
<br />Festival Parade on July 2, 1989. It was noted that the City
<br />wishes to use the North entrance and steps of One Michiana Square
<br />located at 100 East Wayne Street for one of the Ethnic Festival
<br />entertainment areas. Upon a motion made by Mrs. DeClercq,
<br />seconded by Mr. Leszczynski and carried, the Agreement was
<br />approved and executed.
<br />APPROVE CHANGE ORDER NO. 1 - EDWARDO'S PUBLIC IMPROVEMENTS
<br />PROJECT
<br />Mr. Leszczynski advised that L.L. Geans & Sons, Inc., 56535
<br />Magnetic Drive, Mishawaka, Indiana, has submitted Change Order
<br />No. 1 for the above referred to project indicating that the
<br />Contract amount be decreased by $16,494.00 for a new Contract
<br />sum, including this Change Order, in the amount of $49,306.00.
<br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys
<br />and carried, Change Order No. 1 was approved and executed.
<br />APPROVE CHANGE ORDER NO. 1 - WASTEWATER TREATMENT PLANT
<br />IMPROVEMENTS PROJECT - MISCELLANEOUS SLUDGE HANDLING EQUIPMENT
<br />Mr. Randy J. Lindley, Associate, TenEch Engineering, Inc., 744
<br />West Washington Street, South Bend, Indiana and Fruehauf
<br />Corporation, 137 South Olive Street, South Bend, Indiana,
<br />submitted to the Board Change Order No. 1 for two (2) aluminum
<br />dump trailers. The Change Order indicates that the original
<br />Contract price of $46,530.00, shall be increased by $1,535.00 for
<br />a new Contract price of $48,065.00. Mr. Leszczynski noted that
<br />this Change Order adds some items to the trailers that were
<br />purchased in January in conjunction with the Wastewater Treatment
<br />Plant Improvements Project. Therefore, Mr. Leszczynski made a
<br />motion that the Change Order as submitted be approved and
<br />executed. Ms. Humphreys seconded the motion which carried.
<br />APPROVE CHANGE ORDER NOS. 6, 9, 10 & 11 - MIAMI/JACKSON
<br />IRONWOOD/EWING INTERSECTION SIGNALIZATION PROJECT
<br />Mr. Leszczynski advised that Walsh & Kelly,
<br />Road 23, South Bend, Indiana, has submitted
<br />Highways Change Order Nos. 6, 9, 10 & 11 for
<br />to projects. The Change Orders add various
<br />conduits, handholes, common excavation and a
<br />follows:

<br />Therefore, Mr. Leszczynski made a motion that the Change Orders
<br />as submitted and outlined above be approved. Mrs. DeClercq
<br />seconded the motion which carried.
