54 <br />REGULAR MEETING <br />FEBRUARY 27, 1989 <br />APPROVE EXTENSION OF CONTRACT FOR TOWING OF ABANDONED VEHICLES <br />Mrs. Patricia E. DeClercq, Director, Department of Code Enforcement, <br />reminded members of the Board that on February 6, 1989, the Board <br />approved a Vehicle Towing Contract with Mid American Recovery, Inc., <br />1408 Elwood Avenue, South Bend, Indiana, for a thirty (30) day period <br />which included a provision that the Contract can be renewed. <br />At this time, Mrs. DeClercq requested a thirty (30) day extension of <br />the Contract under the same terms as in the Contract previously <br />approved. Therefore, Mrs. DeClercq made a motion that the Contract as <br />previously approved by the Board on February 6, 1989 be extended for a <br />period of thirty (30) days. Mr. Leszczynski seconded the motion and <br />it carried. <br />APPROVE LEASE PURCHASE CONTRACT - 1ST SOURCE AUTO LEASE <br />In a letter to the Board, Mr. John D. Leisenring, Chief Deputy <br />Controller, advised that on February 6, 1989, the Board accepted a <br />Lease Purchase Proposal with 1st Source Auto Lease, Inc., for the <br />acquisition of a tow truck for the Department of Code Enforcement. <br />Mr. Leisenring therefore submitted to the Board today the appropriate <br />documents which represent the Lease Purchase Contract between the City <br />and 1st Source Auto Lease which must be executed by the Board. <br />Therefore, upon a motion made by Mr. Leszczynski, seconded by Mrs. <br />DeClercq and carried, the following documents were approved and <br />executed: <br />- Guidelines for determining excess wear and tear at lease <br />termination <br />- Supplemental to Lease of Personal Property <br />- Motor Vehicle Lease Agreement <br />- Insurance Indemnification Statement <br />APPROVE STATE - LOCAL PUBLIC AGENCY AGREEMENT - TRAFFIC SIGNAL <br />MODERNIZATION AT PORTAGE AND CALIFORNIA AND AT PORTAGE AND FOREST <br />Mr. Leszczynski advised that Mr. Michael P. Meeks, Director, Division <br />of Engineering, has submitted to the Board for approval and execution <br />the standard state Agreement entitled State - Local Public Agency <br />Agreement as received from the Indiana Department of Highways in <br />regards to the traffic signal modernization at Portage and California <br />and at Portage and Forest. Mr. Leszczynski made a motion that the <br />Agreement as submitted be approved and executed. Mrs. DeClercq <br />seconded the motion and it carried. <br />APPROVE RELEASE OF EASEMENT <br />Mr. Leszczynski advised that the Release of Easement submitted today <br />for approval is necessitated due to Can-Am's development in the area <br />of the easement. It was noted that the Release indicates that the <br />City had obtained an easement for storm drainage and sewage for the <br />tract or parcel of land situated on a portion of Lot #1 as shown on <br />the recorded Plat of Mill Race Subdivision.. The Release of Easement <br />releases and terminates all rights and interests in said easement and <br />the utilities will be abandoned in place. Therefore, upon a motion <br />made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the <br />Release of Easement was approved and executed. <br />ADOPT RESOLUTION NO. 8-1989 - TRANSFER OF REAL PROPERTY - 2402 ROSE <br />STREET <br />Mr. Leszczynski advised that Resolution No. 8-1989 relates to the <br />property known as Maple Lane School located at 2402 Rose Street and is <br />the official City acceptance of the property from the South Bend <br />Community School Corporation. Therefore, upon a motion made by Mrs. <br />DeClercq, seconded by Ms. Humphreys and carried, the following <br />Resolution No. 8-1989 was adopted: <br />1 <br />1 <br />
