430 <br />REGULAR MEETING <br />DECEMBER 31, 1990 <br />After discussion with Ms. Taylor about her current use of the <br />alley, it was discovered that she utilized the exit of the alley <br />to turn her car around. Mr. Leszczynski noted that should the <br />alley be vacated, that exit would still be there for her use as <br />the alley would be vacated from the back of the sidewalk <br />right-of-way line. Mr. Lott stated that it is not his intent to <br />block that exit for use as a turnaround. <br />In regards to Mr. Magdalinski's concerns about increased traffic, <br />Ms. Taylor suggested that perhaps Speed Limit and Watch For <br />Children signs could be posted in the alley to slow vehicles <br />down. Mr. Magdalinski still stated that he was concerned about <br />the number of vehicles utilizing the alley at a high rate of <br />speed. He noted that his car was already hit by a hit and run <br />driver. Ms. Taylor noted that four (4) of her cars were hit by <br />hit and run drivers already as well. Mr. Magdalinski stated that <br />his battery was stolen from his driveway twice and now his <br />gasoline is being stolen as well. <br />Mr. Leszczynski advised that it is his opinion that there are <br />more benefits than harm in closing the alley and that getting <br />cars off of the street will help. Also, the turnaround needed by <br />Ms. Taylor will still be there for her use. Mr. Leszczynski <br />stated that the Clerk of the Board will be instructed to advise <br />the Police Chief to monitor the situation because of the number <br />of concerns raised. <br />Therefore, Mr. Leszczynski made a motion that the Clerk forward <br />to the Common Council a favorable recommendation on the above <br />referred to alley vacation subject to any and all utility <br />easements. <br />Mr. Leszczynski suggested to Mr. Magdalinski that he may want to <br />consider vacating the portion of the alley along his house. Ms. <br />Taylor stated that it is her desire that the person making the <br />final decision come out to the area before they consider closing <br />the alley. Mr. Leszczynski advised those present that the Board <br />of Public Works merely makes a recommendation to the Common <br />Council who makes the final decision regarding the closing of the <br />alley. He noted that the Board's review of the Petition is <br />strictly technical and no technical reason can be found why this <br />alley should not be closed. Mr. Leszczynski further stated that <br />this appears to be a neighborhood problem and suggested that <br />residents contact their Councilman and Councilmen at Large to <br />review this situation. Mr. Magdalinski continued his opposition <br />to the closing of the alley and stated that the Board is not <br />thinking right on this matter. <br />Ms. Humphreys seconded the motion made by Mr. Leszczynski that <br />the Board forward to the Common Council a favorable <br />recommendation on this proposed alley vacation. Mrs. DeClercq <br />opposed. <br />APPROVE AGENCY AGREEMENTS - AIRPORT ECONOMIC DEVELOPMENT AREAS <br />Board Attorney Jenny Pitts Manier informed the Board that they <br />previously agreed to act as agent on behalf of the Redevelopment <br />Commission on the Airport 2010 Project and therefore submitted to <br />the Board today were Agency Agreements between the South Bend <br />Redevelopment Authority and the City of South Bend through the <br />Board of Public Works for purposes of the Authority designating <br />the Board to act as its agent for purposes of constructing, <br />purchasing and installing certain improvements in the Airport <br />Economic Development Area. <br />The Agency Agreement which serves as Exhibit A to Redevelopment <br />Authority Resolution No. 26 pertains to the taxable improvements <br />to be constructed in the area and the Agency Agreement attached <br />to Redevelopment Authority Resolution No. 27 pertains to the tax <br />1 <br />1 <br />1 <br />
