410 <br />REGULAR MEETING <br />DECEMBER 17, 1990 <br />quoted are subject to acceptance within thirty (30) <br />days and shall be deemed automatically to have been <br />withdrawn if, by the end of that period, no award has <br />been made. <br />AMERICAN SALT COMPANY <br />4825 North Scott Street <br />Schiller Park, Illinois 60176 <br />Bid was signed by Mr. D.G. Ibbott, Vice -President, Sales/ <br />Marketing Highway -Chem., Non -Collusion Affidavit was in <br />order, Non -Discrimination Commitment form was completed and <br />a Certified Check in the amount of $32,328.00 was submitted. <br />BID: 12,000 tons Bulk De -Icing Rock Salt <br />Total: <br />- F.O.B. South Bend, IN via Dump <br />truckload quantities. <br />Upon a motion made by Mr. Leszczynski, seconded <br />and carried, the above bids were referred to the <br />Department for review and recommendation. <br />BLIC HEARING AND FAVO <br />$26.94/ton <br />$323,280.00 <br />by Ms. Humphreys <br />Street <br />VACATION• 1ST <br />N/S ALLEY E. OF ST. PETER STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />follows: <br />RECOMMENDATION - <br />The first North -South alley East of St. Peter Street <br />located between the north right-of-way line of Howard <br />Street and a line located 66 feet north of said right - <br />of way line, which extends from the northeast property <br />corner of parcel described by St. Joseph County tax Key <br />Number 18-5104-3661.01 to the northwest property corner <br />of parcel described by Key Number 18-5104-3661. The <br />portion of the alley to be vacated is approximately 66 <br />feet in length by 14 feet in width. <br />Part situated in Sorin's Second Addition in the east half <br />of the northeast quarter of Section 1, Township 37 North, <br />Range 2 East, in the City of South Bend, St. Joseph County, <br />IN. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. Timothy J. Hartzer, <br />205 West Jefferson, South Bend, Indiana, on behalf of the Notre <br />Dame Howard Partnership, 702 South Michigan Street, South Bend, <br />Indiana. It was further noted that pursuant to South Bend <br />Municipal Code Section 18-53.8, owners whose property abut the <br />proposed alley to be vacated as well as those affected property <br />owners within one hundred fifty feet (1501) of the proposed alley <br />to be vacated were notified of the Board's Public Hearing date. <br />Mr. Timothy J. Hartzer, 205 West Jefferson, South Bend, Indiana, <br />on behalf of Notre Dame Howard Partnership, Petitioner, was <br />present and addressed the Board. <br />Mr. Hartzer advised that essentially what they are trying to do <br />is generate some flexibility on this site. They are asking that <br />the portion of the alley be vacated but at the same time will <br />give back an easement to the City with the result being no <br />change. What the vacation does is give them some ability to <br />develop the property and they do intend to give an easement back <br />to the City. Mr. Hartzer noted that this process of vacating the <br />alley eliminates some of the problems that they have experienced <br />in developing the property. <br />1 <br />
