REGULAR MEETING <br />AUGUST 20, 1990 <br />The regular meeting of the Board of Public Works was convened at <br />9:35 a.m. on Monday, August 20, 1990, by Board President John E. <br />Leszczynski. Also present were Mrs. Patricia E. DeClercq, Ms. <br />Katherine Humphreys and Board Attorney Jenny Pitts Manier <br />present. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the August 13, 1990, regular meeting <br />of the Board were approved. <br />YUbLIU BEARING/RECOMMENDATIONS TABLED - ALLEY VACATIONS: <br />- 1ST E/W ALLEY SOUTH OF WESTERN AVENUE <br />- 1ST N/S ALLEY WEST OF MAIN STREET <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on the proposed vacation of the following <br />alleys: <br />The lst east -west alley south of Western Avenue, running <br />west from Main Street, for a distance of approximately <br />165 feet to the east line of the lst north -south alley <br />west of Main Street, all in Martin's Addition. <br />and <br />The lst north -south alley west of Main Street, running <br />north from the north line of Monroe Street to the south <br />line of the lst east -west alley north of Monroe Street <br />all in Martin's Addition. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit recommendations to the Common Council <br />concerning the Vacation Petitions which were submitted by Mr. <br />Roger Nawrot, Cole Associates, Inc., 2211 East Jefferson <br />Boulevard, South Bend, Indiana, as the Contact Person. <br />It was further noted that pursuant to South Bend Municipal Code <br />Section 18-53.8, owners whose property abut the proposed alleys <br />to be vacated, as well as those property owners within one <br />hundred fifty feet (1501) of the alleys to be vacated, were <br />notified of the Board's Public Hearing date. <br />Mr. Robert Richert, 412 South Lafayette Blvd., South Bend, <br />Indiana, was present and advised the Board that he is the Branch <br />Manager of Acro Electronics and he is opposed to the closing of <br />the lst east/west alley south of Western Avenue. Mr. Richert <br />stated that the closing of the alley would restrict access to <br />their loading dock. He noted that Acro Electronics is located on <br />Lot #50 owned by Joseph A. and Helen A. Garcia. <br />Mr. Milton Reis, Reis Furniture Company, Inc., 432 South <br />Lafayette Boulevard, South Bend, Indiana, was also present and <br />advised that he is opposed to the closing of both of the above <br />referred to alleys, as the closing of these alleys would also <br />restrict access to the store loading dock. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacations, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mrs. DeClercq and carried, the Public <br />Hearing was closed. <br />As the Petitioners for these alley vacations were not present to <br />speak in favor of the vacations, and as it was determined that <br />the identity of the Petitioners is unknown, Ms. Humphreys made a <br />motion that the Board table this matter until it can be <br />1 <br />F_J <br />
