164 <br />REGULAR MEETING MAY 14, 1990 <br />Mr. Lang indicated that a Bid Bond accompanied the Varian bid and <br />inquired if that did not bind the bid. Ms. Manier advised that <br />the bond company was bound but Varian was not. Failure to sign <br />the bid essentially makes it a failure of Varian to commit to the <br />bid. She noted that the bond was in order but that does not cure <br />the fact that the bid was not signed. <br />Mr. Leszczynski noted that the bid received by Perkin-Elmer <br />Corporation is being reviewed and the only option the City has is <br />to award to them unless there is some reason that the bid has to <br />be thrown out. <br />Mr. Lang informed the Board that the bid Varian originally <br />submitted on February 12, 1990 for this equipment was a duplicate <br />of the bid most recently submitted and inquired whether that bid <br />could be considered. Ms. Manier stated that the bids originally <br />received for this equipment on February 12, 1990 as well as the <br />award of the bid on February 26, 1990 to the Perkin-Elmer <br />Corporation, were rescinded by the Board on April 16, 1990, and <br />that offer does not stand. She noted that the first bid is not <br />responsive to this latest request for bids. Mr. Leszczynski <br />stated that in order to re -bid the equipment, the Board had to <br />reject the bids previously received. <br />In conclusion, Ms. Manier stated that an unsigned bid is a fatal <br />flaw and the Board never accepts such a bid. <br />Mr. Lang thanked the Board for rewriting the specifications for <br />this equipment to reflect a more generic piece of equipment and <br />for readvertising for bids. <br />ADJOURNMENT <br />There being no further business to come before the Board, upon a <br />motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and <br />carried, the meeting adjourned at 9:47 a.m. <br />--- - _ o <br />;�L' i <br />Patricia E.
