In <br />REGULAR MEETING APRIL 23, 1990 <br />RESOLUTION NO. 12-1990 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />ON DISPOSAL OF UNFIT AND/OR OBSOLETE PROPERTY <br />WHEREAS, it has been determined by the Board of Public Works <br />that the following property is unfit for the purpose for which it <br />was intended and is no longer needed by the City of South Bend: <br />ONE (1) 1960 STUDEBAKER CHAMP PICK-UP TRUCK <br />SERIAL NO. E5128736 <br />WHEREAS, Indiana Code 36-1-11-6(c) permits and establishes <br />procedure for disposal of personal property which is unfit for <br />the purpose for which it was intended and which is no longer <br />needed by the City. <br />NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Works <br />of the City of South Bend that the property listed above is no <br />longer needed by the City; is unfit for the purpose for which it <br />was intended; and has an estimated total value of less than Five <br />Hundred Dollars ($500.00). <br />BE IT FURTHER RESOLVED that said property may be transferred <br />or sold at public or private sale, without advertising. However, <br />if the property is deemed worthless, such may be demolished or <br />junked. <br />ADOPTED this 23rd day of April, 1990. <br />BOARD OF PUBLIC WORKS <br />s/John E. Parmerlee, Clerk <br />APPROVE EMERGENCY BOARD -UP CONTRACT <br />Mr. Leszczynski advised that submitted to the Board is an <br />emergency board -up contract which sets into place procedures for <br />the boarding -up of structures after a fire. <br />Fire Chief Luther Taylor advised that the Department has been <br />operating under this procedure for years and they felt it was <br />important to put the procedures and policy in writing at this <br />time. <br />Assistant Chief Bert Prawat advised that Chapter 6 of the South <br />Bend Municipal Code provides that the Department can board up a <br />structure if it is deemed unsafe. In the past the Department has <br />kept a list of contractors who were called, on a rotating basis, <br />to provide these baord-up services. <br />It is noted that the Emergency Board -up Contract as submitted <br />indicates that the Fire Chief is designated as the agent of the <br />Board for the limited purpose of entering into and is authorized <br />to enter into contracts with individual contractors for emergency <br />board -up of structures. Further, Contractors shall be called <br />when necessary off a rotating list which is to be kept available <br />for public inspection at the Fire Department. Any contractor can <br />be placed on the list by filing an application with the Board of <br />Public Works Upon the application being formally filed with the <br />Board, and the posting of the required $1,000.00 bond, the new <br />contractor shall be placed at the bottom of the list. <br />Therefore, Mrs. DeClercq made a motion that the Contract as <br />submitted be approved. Ms. Humphreys seconded the motion which <br />carried. <br />
