W REGULAR MEETING JANUARY 22, 1990 ADOPT RESOLUTION NO. 2-1990 - APPROVING AN AGENCY AGREEMENT BETWEEN THE SOUTH BEND REDEVELOPMENT AUTHORITY AND THE BOARD OF PUBLIC WORKS Ms. Ann Kolata, Deputy Executive Director, Department of Economic Development, advised the Board that the Resolution submitted today for adoption is between the Board and the Redevelopment Authority whereby the Authority asks the Board to handle all construction work on the various projects associated with the bond issue and take responsibility for supervising construction of the projects. Mrs. DeClercq made a motion that Resolution No. 2-1990, approving an Agency Agreement between the Redevelopment Authority and the Board be adopted. Ms. Humphreys seconded the motion which carried and the following Resolution No. 2-1990 was adopted and the referred to Agency Agreement was approved and executed: RESOLUTION NO. 2-1990 RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS APPROVING AN AGENCY AGREEMENT BETWEEN THE SOUTH BEND REDEVELOPMENT AUTHORITY AND THE BOARD OF PUBLIC WORKS WHEREAS, the South Bend Redevelopment Authority (the "Authority") at a meeting on November 16, 1989, adopted Resolution No. 14 approving a proposed Lease between the Authority and the South Bend Redevelopment Commission (the "Commission") for certain land and public improvements (the "Project") to be dated as of November 1, 1989 (the "Lease"), and preliminary plans, specifications and cost estimates for the Project; WHEREAS, the Commission at a meeting on December 8, 1989, after a public hearing on the Lease adopted Resolution No. 901 approving the execution of the Lease; and WHEREAS, the Authority at a meeting on January 17, 1990, adopted Resolution No. 15 approving final plans, specifications and cost estimates for the construction of the Project as filed with the Authority and the execution of an Agency Agreement with the City of South Bend (the "Agency Agreement") by and through the City of South Bend Board of Public Works (the "Board of Public Works") which provides for the construction of the Project by the Board of Public Works and other related matters, a copy of which is attached hereto at "Exhibit "A"; and WHEREAS, the Commission at a meeting on January 19, 1990, adopted Resolution No. 906 which approved said final plans, specifications and cost estimates as filed with the Commission and appointed the Board of Public Works to act as its agent for purposes of approving modifications and amendments to the final plans, specifications and cost estimates for the Project, consistent with the overall design set forth in said final plans, specifications and cost estimates, providing that such modifications do not alter the character of the Project or reduce the value thereof; and WHEREAS, the Board of Public Works desires to enter into the Agency Agreement with the Authority; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AS FOLLOWS: 1. The Board of Public Works hereby approves the execution of the Agency Agreement with the Authority as attached hereto at Exhibit "A". 2. The Board of Public Works hereby accepts for filing the final plans, specifications and cost estimates as approved by the Authority and Commission.
