REGULAR MEETING NOVEMBER 18, 1991 change and enlarge the points of access and egress permitted from their land to and from Cleveland Road, so as to permit the more complete use and development of their land; and WHEREAS, such a change would require a deed from the City releasing limited access restrictions from a portion of the developer's land as follows: DRIVEWAY OPENING NO. 1. That part of the Northwest Quarter of Section 20, Township 38 North, Range 2 East, City of South Bend, German Township, St. Joseph County, Indiana which is described as: Beginning at a Point on the Northerly right-of-way Line of New Cleveland Road which is S. 000-08'-00" W., 762.73 ft. and S. 89°-33'-55" W., 1764.65 ft. from the North Quarter Post of said Section; thence around a 1332.39 ft. radius curve to the right an arc distance of 60.01 ft. to the end of a chord which bears S. 480-11'-39" E. and having a distance of 60.01 ft. to said driveway opening point of termination. DRIVEWAY OPENING NO. 2. That part of the Northwest Quarter of Section 20, Township 38 North, Range 2 East, City of South Bend, German Township, St. Joseph County, Indiana which is described as: Beginning at a Point on the Northerly right-of-way Line of New Cleveland Road which is S. 000-08'-00" W., 1138.09 ft. and S. 89°-33'-55" W., 954.37 ft. from the North Quarter Post of said Section; thence S. 770-33'-56" E., 40.00 ft. to said driveway opening point of termination. WHEREAS, the City's Engineering Division has reviewed the developer's request and has determined that allowing access and egress to and from Cleveland Road at the points requested by the developer will not adversely affect the safe operation of Cleveland Road at this location; and WHEREAS, it is in the City's best interests that the land annexed pursuant to Ordinance No. 6626-79 be developed. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: 1. That the limited access restrictions along Cleveland Road that would prohibit the driveway access and egress as described above should be released. 2. That a deed releasing such restrictions is hereby authorized and the Board empowers the Mayor of the City of South Bend and the South Bend City Clerk to execute and attest such a deed.
