REGULAR MEETING <br />SEPTEMBER 23, 1991 <br />South Walnut Street, South Bend, Indiana, be released effective <br />September 23, 1991. Mrs. DeClercq made a motion that the <br />recommendation be accepted and the bond be released. Ms. <br />Humphreys seconded the motion which carried. <br />APPROVE TITLE SHEETS <br />GARDEN APARTMENT COMPLEX (SEWER/WATER) <br />- SEWER MAIN EXTENSION TO FARM BUREAU INSURANCE (SANITARY SEWER) <br />Mr. Leszczynski advised that the Title Sheets for the above <br />referred to projects were being presented at this time for <br />execution. Upon a motion made by Mrs. DeClercq, seconded by Ms. <br />Humphreys and carried, the above referred to Title Sheets were <br />approved and signed. <br />APPROVE CLAIMS <br />Mr. Juan Manigault, Executive Director, WDS of Northern Indiana, <br />submitted two (2) lists containing one hundred eighteen (118) <br />claims and recommended approval. Upon a motion made by Mrs. <br />DeClercq, seconded by Mr. Leszczynski and carried, the claims <br />were approved and the reports as submitted were filed. <br />PRIVILEGE OF THE FLOOR: <br />COMMENTS CONCERNING BID AWARD - FOUR (4) TANDEM AXLE TRUCKS <br />COMPLETE WITH DUMP BODY AND SNOW ATTACHMENTS <br />Mr. Richard Stopczynski, 706 South Sheridan Street, South Bend, <br />Indiana, was present and advised that he would like to address <br />the Board in two (2) capacities, one as an agent for Wise <br />International Trucks, 4849 West Western Avenue, South Bend, <br />Indiana and as a taxpayer of the City of South Bend. <br />Mr. Stopczynski stated that it is not his intent to create <br />animosity but to call attention to what he feels is an injustice <br />as a bidder. He stated that it was their impression that the <br />City, through its management team, intended to acquire the most <br />economical and most efficient equipment possible. The Board's <br />decision to choose the bid of Shamrock Ford, foregoes the <br />specifications for this equipment and it is therefore their <br />assumption that the large trade-in amount allowed by Shamrock was <br />a consideration in choosing that bid. Mr. Stopczynski stated <br />that the problem they see is that Shamrock Ford bid below minimum <br />specifications when Wise International tried to adhere to the <br />specifications and in doing so created a vehicle that was more <br />costly. Should Wise International also have bid below minimum <br />specifications they could have competed with the bid of <br />Shamrock. He stated that the City accepted less than what they <br />had asked for in the specifications and this action is unfair to <br />all bidders. He requested that the Board require a bid process <br />in which if a bidder cannot perform as to the requirements on the <br />minimum standards that they not be considered. He noted that the <br />South Bend Community School Corporation has recently adopted such <br />a policy and it makes bidding more competitive. <br />Mr. Leszczynski inquired of Mr. Stopczynski just what areas he <br />has concerns with and was advised that the bid of Shamrock Ford <br />which the City accepted was under specifications and the truck <br />bid by Wise International met all specifications in the area of <br />engine and etc. Therefore, the truck bid by Wise was more <br />expensive than what they could have bid because their bid met <br />specifications. Mr. Stopczynski stated that they believe the bid <br />should have adhered to the minimum specifications and that it was <br />because of the larger trade-in amount bid by Shamrock Ford that <br />their bid was accepted. Mr. Leszczynski indicated that it was <br />his belief that Mr. Stopczynski has over exaggerated the <br />situation and Mr. <br />
