REGULAR MEETING AUGUST 12, 1991 The regular meeting of the Board of Public Works was convened at 9:33 a.m. on Monday, August 12, 1991, by Board President John El. Leszczynski. Also present was Board member Patricia E. DeClercq .as well as Board Attorney Jenny Pitts Manier. Board member Katherine Humphreys was not in attendance. AGENDA ITEM ADDED Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq- and carried, the approval of Claims were added to the agenda. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by Mr. Leszczynski .and carried, the minutes of the regular meeting of the Board held on August 5, 1991 were approved. ADOPT RESOLUTION NO. 33-1991 - RENOUNCING A GIFT OF REAL PROPERTY Board Attorney Jenny Pitts Manier advised members of the Board that the Resolution submitted today renounces a gift of real property that was transferred to the City through an estate closing which the City wishes not to accept. Therefore, Mrs. DeClercq made a motion that the Resolution be adopted. Mr. Leszczynski seconded the motion which carried and the following Resolution No. 33-1991 was adopted: RESOLUTION 33-1991 A RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA BOARD OF PUBLIC WORKS RENOUNCING A GIFT OF REAL PROPERTY WHEREAS, one Keith E. Proud was the apparent owner of record on February 19, 1991, of the following described real property situated in St. ,Joseph County, Indiana: A lot or parcel of land -thirty-seven and one-half (37.5) feet in width, North and South, taken off ,and from the entire length of the North side of Lot Numbered Nineteen (19) as shown on the -recorded plat of A.G. Cushing's Second Addition to the City of South Bend. Key number 18 1076 3194. Commonly known as 820 North Allen Street, South Bend, Indiana; and WHEREAS, Keith E. Proud died on February 19, 1991, and one Lowell J. Proud, his son, assumed duties as Personal Representative of his Estate; and WHEREAS, on July 23, 1991 Lowell J. Proud, by F. Gerard Feeney, attorney for the Estate of Keith E. Proud, petitioned the St. Joseph Probate Court to transfer said property as a gift to the City of South Bend, Indiana; and WHEREAS, on July 23, 1991 Judge Peter J. Nemeth of the St. Joseph Probate Court signed an Order Authorizing Transfer of said property as a gift; and WHEREAS, said Petition and Authorization were done without the knowledge of any officer, agent, or employee of the City of South Bend, Indiana, much less at the request of any such officer, agent, or employee; and 11 1
