REGULAR MEETING AUGUST 12, 1991 <br />The regular meeting of the Board of Public Works was convened at <br />9:33 a.m. on Monday, August 12, 1991, by Board President John El. <br />Leszczynski. Also present was Board member Patricia E. DeClercq <br />.as well as Board Attorney Jenny Pitts Manier. Board member <br />Katherine Humphreys was not in attendance. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq- <br />and carried, the approval of Claims were added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Mr. Leszczynski <br />.and carried, the minutes of the regular meeting of the Board held <br />on August 5, 1991 were approved. <br />ADOPT RESOLUTION NO. 33-1991 - RENOUNCING A GIFT OF REAL PROPERTY <br />Board Attorney Jenny Pitts Manier advised members of the Board <br />that the Resolution submitted today renounces a gift of real <br />property that was transferred to the City through an estate <br />closing which the City wishes not to accept. Therefore, Mrs. <br />DeClercq made a motion that the Resolution be adopted. Mr. <br />Leszczynski seconded the motion which carried and the following <br />Resolution No. 33-1991 was adopted: <br />RESOLUTION 33-1991 <br />A RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA <br />BOARD OF PUBLIC WORKS <br />RENOUNCING A GIFT OF REAL PROPERTY <br />WHEREAS, one Keith E. Proud was the apparent owner of record <br />on February 19, 1991, of the following described real property <br />situated in St. ,Joseph County, Indiana: <br />A lot or parcel of land -thirty-seven and one-half <br />(37.5) feet in width, North and South, taken off <br />,and from the entire length of the North side of <br />Lot Numbered Nineteen (19) as shown on the <br />-recorded plat of A.G. Cushing's Second Addition to <br />the City of South Bend. <br />Key number 18 1076 3194. <br />Commonly known as 820 North Allen Street, South Bend, <br />Indiana; and <br />WHEREAS, Keith E. Proud died on February 19, 1991, and one <br />Lowell J. Proud, his son, assumed duties as Personal <br />Representative of his Estate; and <br />WHEREAS, on July 23, 1991 Lowell J. Proud, by F. Gerard <br />Feeney, attorney for the Estate of Keith E. Proud, petitioned the <br />St. Joseph Probate Court to transfer said property as a gift to <br />the City of South Bend, Indiana; and <br />WHEREAS, on July 23, 1991 Judge Peter J. Nemeth of the St. <br />Joseph Probate Court signed an Order Authorizing Transfer of said <br />property as a gift; and <br />WHEREAS, said Petition and Authorization were done without <br />the knowledge of any officer, agent, or employee of the City of <br />South Bend, Indiana, much less at the request of any such <br />officer, agent, or employee; and <br />11 <br />1 <br />
