<br />lands from the Veterans of Foreign Wars, Inc., South Bend Post
<br />No. 1167, by way of Warranty Deed dated October 31, 1951, such
<br />lands being deeded to the City for the use of its Park Department
<br />and/or Board of Park Commissioners; and
<br />WHEREAS, on May 18, 1952, the Park Board executed with the
<br />United States of America a fifty (50) year Land Lease ("Land
<br />Lease") for a portion of said lands, to be used by the United
<br />States of America for construction and occupancy of an organized
<br />reserve corps armory building and appurtenances, which structures
<br />were subsequently constructed; and
<br />WHEREAS, that portion of the lands deeded to the City that
<br />was leased to the United States of America is more commonly known
<br />as the Northside Boulevard Armory; and
<br />WHEREAS, the City of South Bend has been engaged in
<br />discussions with the United States Army concerning its vacation
<br />of the Northside Boulevard Armory and its relocation to another
<br />facility and the release by the United States Army of its
<br />leasehold interest in the Northside Boulevard Armory; and
<br />WHEREAS, Indiana University has expressed interest in
<br />acquiring the Northside Boulevard Armory for use in the expansion
<br />of the campus of Indiana University at South Bend; and
<br />WHEREAS, the Community Foundation of St. Joseph County, Inc.,
<br />(formerly the Civic Foundation), an Indiana not -for -profit
<br />corporation (hereafter the "Foundation"), is desirous of
<br />facilitating both the relocation of the Army Reserve facilities
<br />housed at the Northside Boulevard Armory and the expansion of the
<br />campus of Indiana University at South Bend;
<br />WHEREAS, the City of South Bend, acting by and through its
<br />Board of Public Works, acquired on March 20, 1989, title to the
<br />former Maple Lane School and has proposed that site to the United
<br />States Army as a location to which the reserve corps armory
<br />currently housed at the Northside Boulevard Armory could be
<br />relocated, to which proposal the United States Army has
<br />consented, in principal; and
<br />WHEREAS, by Ordinance No. 8188-91, the Common Council of the
<br />City of South Bend approved and directed the transfer of the
<br />former Maple Lane School by the City of South Bend to the
<br />Foundation, and pursuant to I.C. 36-1-11-1( )( ); and
<br />WHEREAS, the City of South Bend and Foundation are desirous
<br />of memorializing the terms governing the purchase and sale of the
<br />former Maple Lane School by the City of South Bend to the
<br />Foundation, which terms are memorialized in the Purchase
<br />Agreement attached hereto.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS
<br />OF THE CITY OF SOUTH BEND, INDIANA, AS FOLLOWS:
<br />1. The transfer of the following described property,
<br />situated in St. Joseph County, Indiana, by the City of South
<br />Bend, Indiana, to the Community Foundation of ,St. Joseph County,
<br />Inc., (formerly the Civic Foundation):
<br />A part of the South Half of the Southwest Quarter
<br />of Section 32, Township 38 North, Range 3 East
<br />described as follows: Beginning at a point on the
<br />North line of the South Half of said Southwest
<br />Quarter, 399.00 feet East of the Northwest corner
<br />of said South Half; thence North 90000'00" East
<br />along the North line of said South Half 648.00
<br />feet; thence South 0002114171 West, parallel with
