REGULAR MEETING. JANUARY 28, 1991 <br />The regular meeting of the Board of Public Works was convened at <br />9:40 a.m. on Monday, January 28, 1991, by Board President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and <br />Ms. Katherine Humphreys present. Also present was Chief <br />Assistant City Attorney Jenny Pitts Manier. <br />AGENDA ITEM ADDED <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, the opening of bids for Century Center - Dimmer Bank <br />and Lighting Console, was added to the agenda. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by Ms. Humphreys <br />and carried, the minutes of the regular meeting of the Board held <br />on January 21, 1991, were approved. <br />FAVORABLE RECOMMENDATION - ALLEY VACATION: A PORTION OF AN E/W <br />ALLEY SOUTH OF MISHAWAKA AVENUE RUNNING E. FROM 20TH STREET TO <br />21ST STREET <br />Mr. Leszczynski advised that the Board has received Substitute <br />Bill No. 72-1990 from the Common Council along with a letter from <br />the Council Attorney asking the Board to give their <br />recommendation to the Council concerning the vacation of the <br />following alley: <br />An East-West alley South of Mishawaka Avenue running <br />East from 20th Street to 21st Street bordered by Lots <br />5 and 43 on the North and Lots 13 and 42 on the South <br />excepting the north -south alley for a total combined <br />distance of 267 feet more or less, all in Dunn's 1st <br />Addition, the Original Plat of River Park Hammond & <br />Whitcomb Addition and Shank's 1st Addition in the City <br />of South Bend, St. Joseph County, Indiana. <br />Mr. Leszczynski noted that basically what Substitute Bill No. <br />72-90 has done is change the proposed alley vacation from 20th <br />Street to Ironwood to 20th to 21st Streets which was done to <br />address technical concerns of the Police and Fire Departments. <br />The Bill, however, does not address the concerns of Indiana and <br />Michigan Power but those concerns will be addressed later this <br />evening at the Common Council Public Hearing. Mr. Leszczynski <br />noted that in regard to the City's concerns, the revised legal <br />description for this alley vacation does address the technical <br />concerns the City previously had and does reserve the rights of <br />utilities which is typical in vacation petitions. <br />Therefore, Ms. Humphreys made a motion that the Board send a <br />positive recommendation to the Common Council concerning <br />Substitute Bill No. 72-90. Mr. Leszczynski seconded the motion <br />which carried. Mrs. DeClercq abstained. <br />PUBLIC HEARING - INTENT TO DISPOSE OF CITY OWNED PROPERTY AND <br />SALE OF CITY -OWNED PROPERTY - 1716 SOUTH MICHIGAN STREET <br />Mr. Leszczynski advised that this was the date set for the Board <br />of Public Works, as designee of the Mayor, to conduct a Public <br />Hearing to receive or hear comments from persons interested in or <br />affected by the Board's intent to dispose of the following <br />described real property situated in South Bend, St. Joseph <br />County, Indiana: <br />Lots 41 and 42, of Dubail's First Addition, <br />commonly known as 1716 South Michigan <br />Street, South Bend, Indiana. <br />
