REGULAR MEETING JANUARY 21, 1991 The regular meeting of the Board of Public Works was convened at 9:35 a.m. on Monday, January 21, 1991, by Board President John E. Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and Ms. Katherine Humphreys present. Also present was Chief Assistant City Attorney Jenny Pitts Manier. AGENDA ITEM STRICKEN Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, Change Order No. 1 (Final) and Project Completion Affidavit - 1990 Concrete Improvements Project, was stricken from the agenda at this time. APPROVE MINUTES OF PREVIOUS MEETING Upon a motion made by Mrs. DeClercq, seconded by and carried, the minutes of the regular meeting on January 14, 1991, were approved. PUBLIC HEARING 1ST E/W ALLEY Mr. Leszczynsk Board's Public follows: AND FAVORABLE RECOMMENDATION - Ms. Humphreys of the Board held VACATION: 1ST N. OF SOUTH STREET i advised that this was the date set for the Hearing on a proposed alley vacation described as The first east -west alley north of South Street, located between the West line of Fellows Street and the east line of the first north -south alley West of Fellows Street, for a distance of approximately 132 feet and a width of approximately 11 feet, of which the North half of alley is situated in Stern's Subdivision, and the South half of alley is situated in Ann E. Jodon's Subdivision. Both parts are located in the East half of the southwest quarter of Section 12, Township 37 North, Range 2 East, in the City of South Bend, St. Joseph County, Indiana. It was noted that this Public Hearing is being held in order for the Board to submit a recommendation to the Common Council concerning the Vacation Petition filed by Mr. William A. Panzica, Partner, River Glen South Associates, 422 East Monroe Street, South Bend, Indiana. It was further noted that pursuant to South Bend Municipal Code Section 18-53.8, owners whose property abut the proposed alley to be vacated as well as affected property owners within one hundred fifty feet (1501) of the alley to be vacated were notified of the Board's Public Hearing date. Mr. William Panzica, Petitioner, representing River Glen South Associates, 422 East Monroe Street, South Bend, Indiana, was present and addressed the Board. Mr. Panzica advised that the partnership owns the land on the one side and they have just purchased the land opposite the alley to add an additional thirteen (13) parking spaces. He noted that vacating the alley would allow vehicles to pull out into that area. Mr. Panzica further noted that they have had the property rezoned to Commercial to put in the parking spaces and have improved the alley by paving it and putting in an extra dry well. There being no one else present wishing to speak either for or against the proposed alley vacation, and no written objections having been filed with the Board, upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq and carried, the Public Hearing on this matter was closed. Ms. Humphreys noted that the Board is in receipt of favorable recommendations from the various departments and bureaus that have reviewed this Vacation Petition, and she therefore made a motion that the Board forward to the Common Council a favorable recommendation on this alley vacation.
