REGULAR MEETING JANUARY 21, 1991 <br />The regular meeting of the Board of Public Works was convened at <br />9:35 a.m. on Monday, January 21, 1991, by Board President John E. <br />Leszczynski, with Mr. Leszczynski, Mrs. Patricia E. DeClercq and <br />Ms. Katherine Humphreys present. Also present was Chief <br />Assistant City Attorney Jenny Pitts Manier. <br />AGENDA ITEM STRICKEN <br />Upon a motion made by Mr. Leszczynski, seconded by Mrs. DeClercq <br />and carried, Change Order No. 1 (Final) and Project Completion <br />Affidavit - 1990 Concrete Improvements Project, was stricken from <br />the agenda at this time. <br />APPROVE MINUTES OF PREVIOUS MEETING <br />Upon a motion made by Mrs. DeClercq, seconded by <br />and carried, the minutes of the regular meeting <br />on January 14, 1991, were approved. <br />PUBLIC HEARING <br />1ST E/W ALLEY <br />Mr. Leszczynsk <br />Board's Public <br />follows: <br />AND FAVORABLE RECOMMENDATION - <br />Ms. Humphreys <br />of the Board held <br />VACATION: 1ST <br />N. OF SOUTH STREET <br />i advised that this was the date set for the <br />Hearing on a proposed alley vacation described as <br />The first east -west alley north of South Street, located <br />between the West line of Fellows Street and the east line <br />of the first north -south alley West of Fellows Street, for <br />a distance of approximately 132 feet and a width of <br />approximately 11 feet, of which the North half of alley is <br />situated in Stern's Subdivision, and the South half of alley <br />is situated in Ann E. Jodon's Subdivision. Both parts are <br />located in the East half of the southwest quarter of Section <br />12, Township 37 North, Range 2 East, in the City of South <br />Bend, St. Joseph County, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Mr. William A. Panzica, <br />Partner, River Glen South Associates, 422 East Monroe Street, <br />South Bend, Indiana. It was further noted that pursuant to South <br />Bend Municipal Code Section 18-53.8, owners whose property abut <br />the proposed alley to be vacated as well as affected property <br />owners within one hundred fifty feet (1501) of the alley to be <br />vacated were notified of the Board's Public Hearing date. <br />Mr. William Panzica, Petitioner, representing River Glen South <br />Associates, 422 East Monroe Street, South Bend, Indiana, was <br />present and addressed the Board. Mr. Panzica advised that the <br />partnership owns the land on the one side and they have just <br />purchased the land opposite the alley to add an additional <br />thirteen (13) parking spaces. He noted that vacating the alley <br />would allow vehicles to pull out into that area. Mr. Panzica <br />further noted that they have had the property rezoned to <br />Commercial to put in the parking spaces and have improved the <br />alley by paving it and putting in an extra dry well. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Mrs. DeClercq and carried, the Public <br />Hearing on this matter was closed. <br />Ms. Humphreys noted that the Board is in receipt of favorable <br />recommendations from the various departments and bureaus that <br />have reviewed this Vacation Petition, and she therefore made a <br />motion that the Board forward to the Common Council a favorable <br />recommendation on this alley vacation.
