<br />RESOLUTION 49-1992
<br />OF THE BOARD (
<br />FER OF
<br />PUBLIC WORKS
<br />TO REAL SERVICES, INC.
<br />ERTY
<br />WHEREAS, pursuant to I.C. 36-9-6-3, the Board of Public Works
<br />of the City of South Bend (the "Board") has custody of and may
<br />maintain all real property of the City of South Bend; and
<br />WHEREAS, the City of South Bend, Indiana, has received from
<br />the City of South Bend, on behalf of its Department of
<br />Redevelopment, a quit claim deed to the following described real
<br />property situated in St. Joseph County, Indiana::
<br />A lot or parcel of land in the West Half (1/2) of
<br />the Northwest Quarter (1/4) of Section No. Thirteen
<br />(13), Township No. Thirty-seven (37) North, Range
<br />No. Two (2) East, described as follows, viz:
<br />Beginning on the West line of South Michigan Street,
<br />in the City of South Bend, at the Southeast corner
<br />of the Plat of South Bend City, as platted by Samuel
<br />Morrison, now within and a part of the City of South
<br />Bend; thence running South on the West line of
<br />Michigan Street, 35 feet; thence West 10 rods, more
<br />or less, to the East line of a public alley; thence
<br />North on the East line of said alley, 35 feet;
<br />thence East 10 rods, more or less, to the place of
<br />beginning, and now known as Lot Lettered A as shown
<br />on the recorded Plat of Stull's Third Addition to
<br />the City of South Bend. Key No. 18-8004-0192,
<br />("Real Property"); and
<br />WHEREAS, the Board is desirous of conveying its interest in
<br />the Real Property to Real Services, Inc., an Indiana nonprofit
<br />corporation; and
<br />WHEREAS, Real Services, Inc., is desirous of receiving the
<br />Real Property from the Board; and
<br />WHEREAS, pursuant to I.C. 36-1-11-1(b)(7.), the City of South
<br />Bend, acting by and through the Board, may exchange or transfer
<br />property with an Indiana nonprofit corporation; and
<br />WHEREAS, the City of South Bend has agreed to convey the Real
<br />Property to Real Services, and Real Services has agreed to accept
<br />the Real Property from the City for One Dollar ($1.00) and other
<br />good and valuable consideration.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
<br />REDEVELOPMENT COMMISSION AS FOLLOWS:
<br />1. That the conveyance of the following -described real
<br />property by the City of South Bend, acting by and through its
<br />Board of Public Works, to Real Services, Inc.:
<br />A lot or parcel of land in the West Half (1/2) of
<br />the Northwest Quarter (1/4) of Section No. Thirteen
<br />(13), Township No. Thirty-seven (37) North, Range
<br />No. Two (2) East, described as follows, viz:
<br />Beginning on the West line of South Michigan
<br />Street, in the City of South Bend, at the Southeast
<br />corner of the Plat of South Bend City, as platted
<br />by Samuel Morrison, now within and a part of the
<br />City of South Bend; thence running South on the
