REGULAR MEETING NOVEMBER 16, 1992 Therefore, based on the recommendations received, Mr. Caldwell made a motion that the Board send to the Common Council a favorable recommendation concerning this vacation. Mr. Caldwell seconded the motion which carried. RECOMMENDATION TABLED - VACATION OF 14-FOOT ALLEY BETWEEN CLOVER ROAD AND OAKLLAND STREET Mr. Leszczynski indicated that the Common Council has submitted to the Board a Vacation Petition as completed by Grama K. Bhagavan, Valley Engineering Consultants, Inc., 14887 State Road 23, Granger, Indiana, for'Taylor & Moyer Insurance Agency, 1416 Mishawaka Avenue, South Bend, Indiana, to vacate the following alley: A 14-foot alley lying between Clover Road and Oakland Street a length of approximately 361.00 feet, measured east/west and 14.00 feet, measured north/south, situated south of Lots 1 through 5,. 78 and 79, all inclusive of Hibberd Place, said Subdivision being a part of the east half of the northwest quarter of Section 18, Township 37 North, Range 3 East, Portage Township, City of South Bend, St. Joseph County, Indiana. Mr. Leszczynski noted that the Board is in receipt of several recommendations from the various City departments that have reviewed this request. The Board has been advised that the legal description contained in the Ordinance submitted with the Vacation Petition does not correspond to the map which was attached to the ordinance thereby making it unclear what portion of the alley is being requested for vacation. Therefore, Mrs. Mueller made a motion that the Board table providing the Common Council with a recommendation concerning this Vacation Petition until it is in receipt of an Amended Vacation Petition to correct the legal description. Mr. Caldwell seconded the motion which carried. It is noted that the legal description refers to an entire alley but the map submitted indicates just a fragment of the alley. APPROVE EXCAVATION BOND Mr. Larry D. Spadlin, Sr., Division of Engineering, submitted to the Board a Bond for Excavation for B.L. Builders, Inc., 400 South West Street, Mishawaka, Indiana, and recommended approval effective November 16, 1992. Mr. Leszczynski made a motion that the recommendation be accepted and the Bond be approved. Mrs. Mueller seconded the motion which carried. FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORTS Mr. Leszczynski indicated that the Department of Code Enforcement has submitted two (2) lists containing twenty-two (22) miscellaneous and City -owned properties which were cleaned by the Department during the period November 2, 1992 to November 5, 1992. Mr. Leszczynski made a motion that the lists as submitted be accepted and filed. Mr. Caldwell seconded the motion which carried. APPROVE CLAIMS Mr. Kevin Horton, City Controller, submitted to the Board a list containing claims totalling $1,027,812.06 and recommended approval. Therefore, Mr. Caldwell made a motion that the claims be approved as recommended. Mrs. Mueller seconded the motion which carried.
