REGULAR MEETING <br />NOVEMBER 16, 1992 <br />Therefore, based on the recommendations received, Mr. Caldwell <br />made a motion that the Board send to the Common Council a <br />favorable recommendation concerning this vacation. Mr. Caldwell <br />seconded the motion which carried. <br />RECOMMENDATION TABLED - VACATION OF 14-FOOT ALLEY BETWEEN CLOVER <br />ROAD AND OAKLLAND STREET <br />Mr. Leszczynski indicated that the Common Council has submitted <br />to the Board a Vacation Petition as completed by Grama K. <br />Bhagavan, Valley Engineering Consultants, Inc., 14887 State Road <br />23, Granger, Indiana, for'Taylor & Moyer Insurance Agency, 1416 <br />Mishawaka Avenue, South Bend, Indiana, to vacate the following <br />alley: <br />A 14-foot alley lying between Clover Road and Oakland <br />Street a length of approximately 361.00 feet, measured <br />east/west and 14.00 feet, measured north/south, situated <br />south of Lots 1 through 5,. 78 and 79, all inclusive of <br />Hibberd Place, said Subdivision being a part of the <br />east half of the northwest quarter of Section 18, <br />Township 37 North, Range 3 East, Portage Township, <br />City of South Bend, St. Joseph County, Indiana. <br />Mr. Leszczynski noted that the Board is in receipt of several <br />recommendations from the various City departments that have <br />reviewed this request. The Board has been advised that the legal <br />description contained in the Ordinance submitted with the <br />Vacation Petition does not correspond to the map which was <br />attached to the ordinance thereby making it unclear what portion <br />of the alley is being requested for vacation. Therefore, Mrs. <br />Mueller made a motion that the Board table providing the Common <br />Council with a recommendation concerning this Vacation Petition <br />until it is in receipt of an Amended Vacation Petition to correct <br />the legal description. Mr. Caldwell seconded the motion which <br />carried. It is noted that the legal description refers to an <br />entire alley but the map submitted indicates just a fragment of <br />the alley. <br />APPROVE EXCAVATION BOND <br />Mr. Larry D. Spadlin, Sr., Division of Engineering, submitted to <br />the Board a Bond for Excavation for B.L. Builders, Inc., 400 <br />South West Street, Mishawaka, Indiana, and recommended approval <br />effective November 16, 1992. Mr. Leszczynski made a motion that <br />the recommendation be accepted and the Bond be approved. Mrs. <br />Mueller seconded the motion which carried. <br />FILING OF ENVIRONMENTAL CLEAN-UP OF LOTS REPORTS <br />Mr. Leszczynski indicated that the Department of Code Enforcement <br />has submitted two (2) lists containing twenty-two (22) <br />miscellaneous and City -owned properties which were cleaned by the <br />Department during the period November 2, 1992 to November 5, <br />1992. Mr. Leszczynski made a motion that the lists as submitted <br />be accepted and filed. Mr. Caldwell seconded the motion which <br />carried. <br />APPROVE CLAIMS <br />Mr. Kevin Horton, City Controller, submitted to the Board a list <br />containing claims totalling $1,027,812.06 and recommended <br />approval. Therefore, Mr. Caldwell made a motion that the claims <br />be approved as recommended. Mrs. Mueller seconded the motion <br />which carried. <br />
