REGULAR MEETING <br />NOVEMBER 9, 1992 <br />35 <br />1 <br />1 <br />Based on the recommendations received, Mr. Caldwell made a motion <br />th <br />at the Board send to the Common Council a favorable <br />recommendation concerning this alley vacation. Mrs. Mueller <br />seconded the motion which carried. <br />APPROVE CONSENTS TO ANNEXATION AND WAIVER OF RIGHT TO <br />REMONSTRATE: <br />- LOT #7, DIXIE-BY-HOMES ADDITION <br />- SPRINGWOOD ESTATES - SECTION I <br />Mr. Leszczynski noted that the Engineering Department has <br />submitted a Consent to Annexation and Waiver of Right to <br />Remonstrate as signed by Ms. Maureen C. Virgil, 125 East Pendle <br />Street, (Lot #7, Dixie -By -Homes Addition - Key #03-1135-0368), <br />South Bend, Indiana. The Consent indicates that in consideration <br />for permission to tap into the public sanitary sewer system of <br />the City to provide sanitary sewer service to this property, Ms. <br />Virgil waives and releases any and all right to remonstrate <br />against future annexation of the property by the City. <br />The Board is also in receipt of a Consent to Annexation and <br />Waiver of Right to Remonstrate as submitted by Mr. David A. <br />Eckrich, President and Ms. Betty J. Babcock, Secretary, Adams <br />Road Development Corporation, in regards to Springwood Estates, <br />Section I. <br />Additionally, the Engineering Department has submitted a Consent <br />as executed by Iris Weiss Sessions, President and Harlan H. <br />Sessions, Secretary/Treasurer, Weiss Homes, Inc., 828 East <br />Jefferson Boulevard, South Bend, Indiana, in regards to <br />Farmington Meadows, Phase II. Therefore, Mrs. Mueller made a <br />motion that the Consents be accepted and approved. Mr. Caldwell <br />seconded the motion which carried. <br />APPROVE RELEASE OF EASEMENT - KENSINGTON FARMS <br />Board Attorney and Member Mary H. Mueller advised that this <br />Release of Easement concerns an Easement for a storm sewer in the <br />Kensington Farms Subdivision. She noted that this sewer is not <br />yet laid but this subdivision is being replatted and the sewer <br />easement being conveyed to the City is being moved as part of the <br />replat. Therefore this Easement needs to be released. Mrs. <br />Mueller made a motion that the Release be approved and executed. <br />Mr. Leszczynski seconded the motion which carried. <br />ArrRUVE AGREEMENT - NORTHERN INDIANA COMMUTER TRANSPORTATION <br />DISTRICT - (SOUTH SHORE) <br />Board Attorney and Member Mary H. Mueller advised that Mr. Carl <br />P. Littrell, Director, Division of Engineering, has submitted to <br />the Board an Agreement between the City and the Northern Indiana <br />Commuter Transportation District regarding the South Shore. This <br />Agreement involves various matters relating to the South Shore <br />relocation to the airport having to do with South Shore crossings <br />at Bendix and Lincolnway and provides for such items as <br />signalization and drainage as well as reimbursing the City <br />$6,000.00 to pay for the City's expenses in this regard. Mrs. <br />Mueller noted that the Engineering Department has recommended <br />approval of this Agreement. <br />It is noted that the Agreement indicates that at the intersection <br />of the District's right-of-way with Bendix Drive north of <br />Lincolnway, the District will install inlet/catch basins at the <br />southeast and northeast corners of the crossing. The City will <br />provide reclaimed castings appropriate for use with the <br />District's materials at this location. Additionally, with <br />regard to Hartzer Street crossing, the parties agree that the <br />District may temporarily barricade the Hartzer Street crossing <br />
