REGULAR MEETING <br />OCTOBER 5, 1992 <br />to Carl G. and Darlene Ewing. Mrs. Mueller noted that the <br />Ewing's have paid their property tax and the County has asked <br />that the City return this vacant lot to them. Mrs. Mueller noted <br />that this is a vacant lot next door to the Ewing's residence. <br />Therefore, Mr. Caldwell made a motion that the Resolution as <br />prepared and submitted be adopted. Mrs. Mueller seconded the <br />motion which carried and the following Resolution No. 39-1992 was <br />adopted: <br />RESOLUTION NO. 39-1992 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />AUTHORIZING THE TRANSFER OF A CERTAIN PARCEL <br />OF REAL PROPERTY TO CARL G. AND DARLENE EWING <br />WHEREAS, the City of South Bend, Indiana (hereinafter the <br />"City"), is the owner of a parcel of real property situated in <br />the City of South Bend, St. Joseph County, Indiana, and being <br />more particularly described as follows: <br />Key No. 18-7048-1878 <br />Lot numbered 115 of Henry Studebaker's Second <br />Addition to the City of South Bend, Indiana, <br />commonly known as 522 Dayton; and <br />WHEREAS, said real property was obtained by the City from St. <br />Joseph County (hereinafter "County"), from among the parcels held <br />for the County Owned Property Sale for the price of One Dollar <br />($1.00) per parcel, with the understanding that the City would <br />use such parcel and other parcels so obtained for community and <br />economic development purposes; and <br />WHEREAS, the County has requested that the City convey said <br />parcel to its previous owners, Carl G. and Darlene Ewing, since <br />said owners lost the property through the failure of their <br />mortgage company to pay the real estate taxes thereon, and since <br />the taxes owed on said property are now satisfied; and <br />WHEREAS, said property is a small, vacant lot, with an <br />assessed value of less than Five Hundred Dollars ($500.00), and <br />the City is willing to transfer said property as requested by the <br />County. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works <br />of the City of South Bend, Indiana, as follows: <br />1)The City shall transfer to Carl G. and Darlene Ewing a <br />parcel of real estate more particularly described as follows: <br />Key No. 18-7048-1878 <br />Lot numbered 115 of Henry Studebaker's Second <br />Addition to the City of South Bend, Indiana, <br />commonly known as 522 Dayton. <br />2)Such transfer shall be accomplished by quit -claim deed, <br />executed by the Mayor of the City of South Bend and attested to <br />by the South Bend City Clerk. <br />3)Such transfer shall be made by the City to Carl G. and <br />Darlene Ewing in an "as is" condition with no warranties, <br />indemnities or representations made relative to said real <br />property. <br />
